En el presente informe, se analizan los conceptos de recurso de revisión, idoneidad y
garantías, a la luz de un caso llevado ante el INDECOPI por la presencia de desperfectos
en un producto adquirido por un consumidor. En este sentido, el autor, a raíz de un caso
en concreto llevado ante el INDECOPI, vía recurso de revisión, analiza cómo y cuál fue
el criterio usado por la autoridad para resolver este caso y que – posteriormente – fue
dejado de lado al poco tiempo. Por ello, el autor se propone, a raíz del análisis de ambos
casos, tomar una postura respecto a cuáles son las definiciones de idoneidad y garantías,
para posteriormente determinar cuándo estamos ante una infracción del deber de
idoneidad y quien debería ser el agente responsable o el que está en mejor posición de
soportar los efectos de la infracción de la idoneidad de un producto. / In this report, the concepts of appeal for review, suitability and guarantees are analyzed,
in the light of a case brought before INDECOPI due to the presence of defects in a product
purchased by a consumer. Because of this, the author, as a result of a specific case brought
before INDECOPI, via an appeal for review, analyzes how and what was the criterion
used by the authority to resolve this case and that - subsequently - was set aside shortly
weather. For this reason, the author proposes, as a result of the analysis of both cases, to
take a position regarding what are the definitions of suitability and guarantees, to later
determine when we are facing an infringement of the duty of suitability and who should
be the agent responsible or who is in the best position to bear the effects of the
infringement of the suitability of a product.
