En el presente trabajo de investigación, se tiene como objetivo determinar el rol del mejor
derecho de propiedad en los casos de duplicidad de partidas.
Para esto, en primer lugar, se analizará Sentencia de Casación N°9706-2017-Lima-Sur,
en dónde la Corte Suprema se analizó un caso de duplicidad de partidas, en el que ambas
partes afirmaban tener la titularidad de la propiedad del inmueble y era necesario
determinar cuál de los dos títulos se debía preferir sobre el otro.
De esta manera, para realizar dicho análisis, primero se revisará los antecedentes del caso,
así como el análisis que realizó originalmente la Corte Suprema. A partir de dicha
revisión, se procederá a analizar la duplicidad de partidas, el por qué se considera una
patología del registro, y por qué no son aplicables los derechos registrales en estos casos.
Por último, se analizará el mejor derecho de propiedad y el criterio que se debe emplear
ante los casos en que se haya generado un conflicto de derechos debido a la existencia de
la duplicidad de partidas. / In this research work, the objective is to determine the role of the best property rights in
cases of duplication of items.
For this, in the first place, the judgment of Cassation N ° 9706-2017-Lima-Sur will be
analyzed, where the Supreme Court analyzed a case of duplication of items, in which both
parties claimed to have ownership of the property of the property and it was necessary to
determine which of the two titles should be preferred over the other.
In this way, to carry out said analysis, the background of the case will first be reviewed,
as well as the analysis originally carried out by the Supreme Court. From this review, we
will proceed to analyze the duplication of items, why it is considered a registration
pathology, and why registration rights are not applicable in these cases.
Finally, the best property rights and the criteria to be used in cases where a conflict of
rights has been generated due to the existence of duplication of items will be analyzed.
