Previous issue date: 2017 / O presente trabalho lança um olhar sociológico para o tema da judicialização da educação com o objetivo de investigar a concepção de educação do Ministério Público de Florianópolis. A partir da pesquisa em meio documental (análise de conteúdo dos textos que fundamentam a abertura e encerramento dos processos entre 2004 e 2015) na 25a Promotoria da Capital (especializada em educação) constatou-se a tênue margem que delimita as fronteiras entre a defesa de direitos educacionais e a ingerência sobre a proposição de modelos educacionais distintos, por vezes pautados em concepções e visões não fundamentadas científica e academicamente. Pautado num referencial teórico da sociologia e sociologia política como Pierre Bourdieu e Rogério Arantes, a pesquisa também verificou que esta promotoria atua num sentido muito específico ao Ministério Público que é o de afirmar e legitimar a sua necessidade de existência enquanto defensora dos direitos constitucionais por meio de demandas e processos que a própria instituição é a principal propositora. A judicialização da educação em Florianópolis - por meio da atuação do Ministério Público ? se apresenta, também, como uma característica de um movimento nacional de crescimento de poder desta instituição na defesa de direitos constitucionais, e aqui, da educação.<br> / Abstract : This dissertation presents a sociological perspective on the topic of the judicialization of education with the objective of investigating a conception of education from the Public Ministry of Florianopolis. From the research in documentary media (content analysis in the texts of grounding of opening and closure from the process among 2004 and 2015) at the 25th Prosecution of Justice (specialized in education), a margin was established that delimits the boundaries between a defense of educational rights and an interference with the proposition of distinct educational models, sometimes based on concepts and visions not scientifically and academically substantiated. Guided by a theoretical framework of sociology and political sociology such as Pierre Bourdieu and Rogério Arantes the research also verified that this Prosecution of Justice acts in the very specific sense of the Public Ministry which is to confirm and legitimize it?s own necessity of existence to support and defend constitutional rights through lawsuits and processes that the institution itself is a main proposal. The judicialization of education in Florianopolis - through the Prosecution of Justice - is also a feature of a national movement for the growth of the institution's power to defend constitutional rights, and here, education.
