Previous issue date: 2016-08-18 / The present study seeks to investigate the regulation of the National Education System (SNE) - as determined by the law which established the National Education Plan (PNE) from 2014 to 2024 and the current wording of Article 214 of the Constitution of the Federative Republic of Brazil 1988 (CF / 88) - may contribute to the institutionalization of a collaborative and federative cooperation without violating the constitutional autonomy of federal entities. Therefore, they are studied some historical factors that marked out the paths that led to the institutional disarticulation of national educational policies, as well as it appears as the political and administrative decentralization in educational matters led to the need to establish able to articulate and coordinate education policies national. Moreover, it is a study of the legal contours of the Brazilian educational federalism, from the perspective of CF / 88 and Law of Directives and Bases of National Education in force (LDB / 1996), to investigate whether the current constitutional order and legal admits that the national education receive systematic treatment. After presents ways to institutionalize the SNE, from what was determined by the PNE 2014-2024, the Second National Conference on Education (CONAE) and the initial proposal of the Ministry of Education (MEC) - published in July 2015. In Finally, points debates about the possibility of institutionalizing the SNE, based on authors perform a connection between the field of public policy and the law. / Pela presente pesquisa procura-se investigar se a normatização do Sistema Nacional de Educação (SNE) - conforme determinado pela lei instituidora do Plano Nacional de Educação (PNE) 2014-2024 e pela atual redação do artigo 214, da Constituição da República Federativa do Brasil de 1988 (CF/88) -, poderá contribuir para a institucionalização de um regime de colaboração e cooperação federativa, sem violar a autonomia constitucional dos entes federados. Para tanto, são estudados alguns fatores históricos que demarcaram os caminhos que levaram à desarticulação interinstitucional das políticas educacionais nacionais, assim como verifica-se como a descentralização político-administrativa em matéria educacional acarretou a necessidade de se instituir políticas capazes de articular e coordenar a educação nacional. Ademais, faz-se um estudo sobre os contornos jurídicos do federalismo educacional brasileiro, a partir da ótica da CF/88 e da Lei de Diretrizes e Bases da Educação Nacional em vigor (LDB/1996), para se investigar se a atual ordem jurídica admite que a educação nacional receba o tratamento sistematizado. Após, apresenta caminhos para a institucionalização do SNE, a partir do que ficou determinado pelo PNE 2014-2024, pela II Conferência Nacional de Educação (CONAE) e pela proposta inicial do Ministério da Educação (MEC) – publicada em julho de 2015. Em último lugar, aponta debates sobre a possibilidade de se institucionalizar o SNE, com base em autores que realizam uma aproximação entre o campo das políticas públicas e do Direito.
