Previous issue date: 2008-08-13 / The aim of this study is to purpose a reflection on the value of the human work, constitutionally presented in two aspects: social, considering that the human work is established as a Republic essential ground, combined with the protection of the human dignity (article 1º, inc. III and IV), with the objective of building a free, fair and joint society (article 3º, inc. I); and economic, considering that the valorization of the human work is the base upon the economic order is funded, with the purpose to present a dignify existence (article 170). Establishing a parallel between the constitutional aim and the contemporaneous reality, the focus of this study is to investigate the current crisis of the Welfare State proposed by the Federal Constitution, mentioning questions as: collision among constitutional principles; effective and applicable laws rules and the transition of the society, that presents real crisis, due to the globalization and the trade-off. In this scenario, it concludes that it is necessary the development of a new constitutional hermeneutic, more appropriated and compatible to the objectives of the current society. / O objetivo deste estudo é propor uma reflexão sobre o valor do trabalho humano, previsto constitucionalmente em duas vertentes: a social, na medida em que o trabalho humano é apresentado como fundamento da República, aliado à proteção da dignidade humana (artigo 1º, incisos III e IV), com o nítido objetivo de se construir uma sociedade livre, justa e solidária (artigo 3º, inciso I); e a econômica, pois a valorização do trabalho humano é o ponto sobre o qual se funda a própria ordem econômica, com o objetivo de assegurar a todos existência digna (artigo 170). Traçando-se um paralelo entre a pretensão constitucional e a realidade contemporânea, o foco deste trabalho é investigar a atual crise do Estado de Bem-Estar Social proposto pela Constituição Federal, abordando-se questões como: colisão de princípios constitucionais; efetividade e aplicabilidade de normas e a transição da sociedade, que hoje apresenta crises reais, em face da globalização e do desemprego. Neste cenário, conclui-se pela necessidade do desenvolvimento de uma nova hermenêutica constitucional, mais apropriada e compatível com os anseios da atual sociedade.
