En el presente artículo, el autor reflexiona sobre el tratamiento que ha efectuado últimamente la jurisprudencia europea, principalmente la italiana, sobre la responsabilidad civil. El autor aborda la figura de la responsabilidad objetiva bajo la perspectiva de que es una categoría jurídica muy discutida en la doctrina civil a lo largo de los últimos tiempos; pero que, a su vez, es una institución acogida muy recientemente por la jurisprudencia. Ello debido, según el autor, a la noción de culpa ligada a la costumbre práctica de los tribunales. Finalmente, Alpa pone énfasis en explicar la dirección en la que está encaminándose la jurisprudencia respecto a este tema. In this article, the author reflects on the treatment that European jurisprudence has given recently to the question of civil responsibility, with an emphasis on Italy. In addition, he analyzes the legal concept of strict liability, which is a juridical category that often has been discussed in civil doctrine in recent years but which, nevertheless, is an institution that has been adopted only very recently by jurisprudence. The reason for this delay is the notion of guilt developed in customary practice of the courts. Finally, Alpa emphasizes the tendencies of current jurisprudential policy on this issue.
