about judicialization of politics, the politicization of justice, Judicial Activism and the
actions of the Supreme courts of Brazil. The theme is a theoretical approach to the
judicialization of politics and activism as phenomenon of empowerment of the
judiciary, and how these phenomenon affect the political and democratic life of
Brazilian society. The main problem studied was that, even if it were an organ of the
judiciary, the court would also have its political role in society, what would be its role
and limits in exercising it? In order to do so, it was necessary to study the main
conceptual differences between judicial judicialization and judicial activism, the limits
of judicial action and the application of the norm. The major motive that generated
political empowerment by the courts, in addition to the post-1988 democratic
institution, was that the population does not trust the other institutions, especially the
Executive, for failing to meet social demands and growing corruption in with
Legislative. It was concluded that the work of the Judiciary goes far beyond the
issues that are brought to it in the area of law and legislation before the Constitution.
There is also an involvement in the political and social regulation itself, impacting on
Brazilian democracy as a whole. / Esta dissertação é resultado de estudos bibliográficos temáticos e jurisprudenciais
sobre a judicialização da política, a politização da justiça, o Ativismo Judicial e a
atuação das cortes superiores do Brasil. O tema envolve uma abordagem teórica
acerca da judicialização da política e do ativismo como fenômenos de
empoderamento do poder judiciário, e de que forma afetam na vida política e
democrática da sociedade brasileira. A problemática principal estudada foi a de que,
mesmo sendo um órgão do judiciário, a corte teria também seu papel político na
sociedade?, qual seria esse papel e seus limites ao exercê-lo? Para tanto, foi
preciso o estudo sobre as principais diferenças conceituais entre judicialização da
política e ativismo judicial, os limites da atuação judicial e a aplicação da norma. O
maior motivo que gerou o empoderamento político por parte dos tribunais, além da
instituição democrática pós Constituição de 1988, foi o de que a população não
confia nas demais instituições, em destaque o Executivo, por não corresponder as
exigências sociais e pela crescente corrupção em conjunto com Legislativo.
Concluiu-se que a atuação do Judiciário vai muito além das questões que são
levadas a ele no quesito de direito e legislação perante a Constituição. Há também
um envolvimento na própria regulamentação política e social, repercutindo na
democracia brasileira como um todo.
