El presente informe jurídico analiza el Expediente N° 000282-2013/CEB-INDECOPI,
correspondiente a una denuncia de parte seguido por Aba Singer & CIA S.A.C. contra la
Municipalidad Metropolitana de Lima.
Con el objetivo de profundizar lo desarrollado por los operadores resolutivos, el trabajo
aborda las problemáticas identificadas, en primer lugar, desde la visión de las restricciones
como manifestación del poder de policía administrativa; en segundo lugar, desde la
metodología establecida por el artículo 26°BIS del Decreto Ley N° 25868 y el Decreto
Legislativo N° 1256; y, en tercer lugar, desde la jurisprudencia administrativa del Indecopi, a
través del tiempo.
De esta manera, el lector al finalizar la revisión del presente documento podrá identificar lo
siguiente: (i) problemas jurídicos del expediente analizado, (ii) las diferencias y similitudes
entre la normativa vigente al momento de la denuncia y la actual, (iii) la metodología
aplicable al procedimiento de eliminación de barreras burocráticas, (iv) la aplicación de la
norma en casos concretos, (v) conceptos claves respecto del análisis de razonabilidad. / This paper analyzes the File N° 000282-2013/CEB-INDECOPI, related to the procedure
initiated by Aba Singer & CIA S.A.C. against the Metropolitan Municipality of Lima.
With the aim of deepening what has been developed in this file, the work addresses the
problems identified. Firstly, from the perspective of the restrictions as a manifestation of the
power of the administrative police; secondly, from the methodology established by the article
26°BIS of Decree Law N° 25868 and the Legislative Decree N° 1256; and, thirdly, from the
administrative jurisprudence of Indecopi, within over the time.
In this way, the reader at the end of this document will be able to identify the following
concepts: (i) legal problems of this file, (ii) the differences and similarities between the past
regulation and the current one, (iii) the methodology applicable to the elimination of
bureaucratic barriers procedure, (iv) the application of the rule in specific cases, (v) key
concepts regarding the analysis of reasonableness.
