nÃo hà / The purpose of this work is to visualize the available instruments wich judges have so that
they can be fair in applying sentences. The general objective was fulfilled through the
following specific objectives: we verified the lack of instruments which judges have in order
to apply the law fairly and we analyzed how the elements of the theory of interpretation are
used in practice by judges. We intended to give to this dissertation a practical and real focus
of interpretation and application of law by judges. That is why we chose the structured
interviewed as a technique. So, three judges were interviewed and the same questions were
made. The questions were previously organized and they followed the same order in all
interviews. From the interviews, we wrote down the answers given by the judges and we
selected the most expressive parts of the judges talk. After that, these parts were reduced to
meaningful unit contexts that is the most important expressions and phrases from the
interviews were selected and organized in such contexts so that the essential content could be
easily understood. These meaninful unit contexts were organized in parts for reflection and
they were the origin for the development chapters of this work: the importance of the
extrajuridical knowledge, sources of law, ways of interpretation, application of law with
security, application of law with in security. With the data collected through the interviews,
we compared them with the bibliography already available. To sum up, we concluded that
judges make use of something undetermined in order to apply the law fairly because there is
no juridical instrument that can cover all the reality of law / O presente trabalho objetivou visualizar os instrumentos de que os juÃzes dispÃem para uma aplicaÃÃo justa do direito. Esse objetivo geral foi perseguido atravÃs dos seguintes objetivos
especÃficos, que serviram de instrumentos para a consecuÃÃo daquele: verificar a insuficiÃncia de instrumentos de que se servem os juÃzes para uma aplicaÃÃo justa do direito e analisar
como os elementos da teoria da interpretaÃÃo sÃo utilizados, na prÃtica dos juÃzes. Pretendemos dar à dissertaÃÃo um enfoque mais prÃtico e real da interpretaÃÃo e aplicaÃÃo do direito por parte dos juÃzes. Por isso, optamos pela tÃcnica da entrevista estruturada e gravada. Assim, trÃs juÃzes foram entrevistados, sendo feitas as mesmas perguntas a todos eles, perguntas essas que foram previamente estabelecidas e formuladas seguindo a mesma seqÃÃncia em todas as entrevistas. A partir das entrevistas realizadas, transcrevemos as respostas dadas pelos entrevistados e selecionamos os trechos mais expressivos das falas dos juÃzes. Em seguida, esses trechos foram reduzidos em contextos de unidades de sentido, ou seja, as expressÃes e frases mais importantes dos trechos das falas dos juÃzes foram
selecionadas e organizadas em tais contextos para que fosse entendido o conteÃdo essencial que os entrevistados quiseram ressaltar. Esses contextos de unidades de sentido foram
agrupados em blocos para reflexÃo, os quais originaram os capÃtulos do desenvolvimento do presente trabalho: A ImportÃncia dos Conhecimentos ExtrajurÃdicos, Fontes do Direito, Modalidades de InterpretaÃÃo, AplicaÃÃo do Direito com SeguranÃa, AplicaÃÃo do Direito com InseguranÃa. De posse dos dados coletados nas entrevistas, os mesmos foram confrontados com a bibliografia existente. Por fim, concluÃmos que os juÃzes recorrem ao indeterminado para uma aplicaÃÃo justa do direito, uma vez que nenhum instrumento jurÃdico pode abraÃar toda a realidade do Direito
