El presente trabajo de investigación académico tiene como objetivo determinar si existe
algún supuesto en el que un proveedor pueda discriminar a un hombre por una razón de
género. Con la finalidad de delimitar la materia de investigación, el objetivo será resuelto
en función al análisis de la Resolución Nº 1121-2020/SPC-INDECOPI, en la cual se han
identificado tres problemas jurídicos: (i) si el denunciado había incurrido en una presunta
infracción a los artículos 1º.1. literal d) y 38º o al artículo 41º del Código de Protección y
Defensa del Consumidor, (ii) si los medios probatorios ofrecidos por la parte denunciante
habrían sido suficientes para acreditar la conducta infractora del proveedor y, por último,
(iii) si la sanción imputada guardaba correspondencia con la presunta infracción cometido
por el proveedor.
Los instrumentos utilizados para poder llevar a cabo el análisis del caso han sido las
resoluciones del Indecopi, la doctrina, las normas del sistema jurídico peruano, las
mismas que permiten concluir que sí pueden existir supuestos en los que un consumidor
puede ser discriminado por tener la condición de hombre y que dicha afectación pueda
extenderse, en caso de encontrarse acompañado, a una tercera persona que podría gozar
de alguna protección especial determinada por la ley. / The purpose of this academic research is to determine whether there are any
circumstances in which a supplier can discriminate against a man on the basis of gender.
In order to delimit the subject of investigation, the objective will be resolved based on the
analysis of Resolution Nº 1121-2020/SPC-INDECOPI, in which three legal problems
have been identified: (i) whether the defendant had committed an alleged infringement of
Articles 1.1 (d) and 38 or 41 of the Consumer Protection and Defence Code, (ii) whether
the evidence offered by the complainant was sufficient to prove the supplier's infringing
conduct and, finally, (iii) whether the sanction imposed corresponded to the alleged
infringement committed by the supplier.
The instruments used to carry out the analysis of the case have been the resolutions of
Indecopi, the doctrine, the rules of the Peruvian legal system, which allow us to conclude
that there may be cases in which a consumer may be discriminated against for being a
man and that such affectation may extend, if accompanied, to a third person who could
enjoy some special protection determined by law.
