Previous issue date: 2010-04-14 / This research investigates the domestic labor from the viewpoint of
the principle of human dignity, studies the Brazilian and international
legislation, making a comparison between the two laws, the study is
motivated by the important lack of literature that deals specifically the
domestic labor Brazilian and internationally as well as the lack of
standards that oversee the theme. The problem of labor is characterized
when the legislature in Article 6 of the consolidation of labor laws states
that there is no discrimination between employee conventional and the
home, however, to legislate so generalizes the two situations and does
not provide effective instruments for achieving of distinction and
protection to the employee at home. To perform this work, we used the
literature review and logical-deductive method, proposed by the
rationalists Descartes, Spinoza and Leibniz presupposes that reason
alone can lead to true knowledge, the theoretical framework of the study
bolsters the principle of the dignity of human person. In the first chapter
we discuss the historical evolution of domestic labor and employment
law in Brazil, the social division of labor according to Marx's
assumptions, the concepts of work at home, the self-employed and
teleworking. In the second chapter we define and analyze the
requirements that characterize the employment relationship, we also
studied here, and the legal nature of the employment relationship. In the
third chapter began with the history of the International Labour
Organisation and posteriromente analyze the domestic labor in Brazil
and the relationship between the domestic labor as the ILO and the
CLT. / Esta pesquisa investiga o trabalho a domicílio sob a ótica do
princípio da dignidade humana, estuda a legislação brasileira e
internacional, fazendo um comparativo entre as duas legislações, o
estudo é motivado pela escassez de literatura que trata de forma
específica o trabalho a domicílio brasileiro e internacional, bem como a
falta de normas que tutelam o tema estudado. O problema do trabalho
caracteriza-se quando o legislador no artigo 6º da consolidação das leis
trabalhistas determina que não há discriminação entre o empregado
convencional e o a domicílio, no entanto, ao legislar assim, generaliza
as duas situações e não fornece instrumento efetivos para o
cumprimento da distinção e proteção ao empregado a domicílio. Para
realizar o presente trabalho, utilizamos a pesquisa bibliográfica e o
método lógico-dedutivo, proposto pelos racionalistas Descartes,
Spinoza e Leibniz que pressupõe que só a razão é capaz de levar ao
conhecimento verdadeiro, o referencial teórico do estudo se ampara no
princípio da dignidade da pessoa humana. No primeiro capítulo
abordamos a evolução histórica do trabalho a domicílio e do direito do
trabalho no Brasil; a divisão social do trabalho segundo os pressupostos
de Marx, os conceitos de trabalho a domicílio, o trabalhador autônomo e
o teletrabalho. No segundo capítulo definimos e analisamos os
requisitos que caracterizam a relação de emprego; estudamos também
neste capítulo e a natureza jurídica da relação trabalhista. No terceiro
capítulo iniciamos com o histórico da Organização Internacional do
Trabalho e posteriromente analisamos o trabalho a domicílio no Brasil e
a relação entre o trabalho a domicílio conforme a OIT e a CLT.
