(PSA) se extiende como un instrumento innovador para financiar la conservación de la
naturaleza y el buen manejo de los recursos naturales. Sin embargo, aún se presenta como
una nueva herramienta de gestión medioambiental donde las variables locales y las
condiciones previas a su instalación pueden determinar su potencial éxito, por lo que
existen múltiples recomendaciones y desafíos para mejorarlos.
Dado que en Chile aún no se llevan a cabo iniciativas de este tipo, se estimó relevante y
necesario abordar el estudio de los PSA en general y de los PSA Hídricos en particular dada
la condición estratégica de ese recurso, mediante la identificación y síntesis de los
requerimientos previos que son necesarios para implementarlos en el país.
Con ese propósito el trabajo se dividió en tres etapas. El primer paso consistió en analizar y
sintetizar la literatura de sistemas de PSA, mediante el método teórico de “Análisis y
Síntesis”, que permitió identificar las condiciones y elementos que pueden influir en la
implementación de un PSAH. En la segunda etapa, se revisó el marco legal e institucional
relacionado a los recursos hídricos en Chile y se seleccionaron las características
pertinentes a los requerimientos identificados y seleccionados en la etapa anterior.
Finalmente, en la tercera etapa, mediante el cruce de los resultados de las etapas
precedentes, se sintetizaron los hallazgos que pueden limitar la viabilidad o factibilidad de
implementación de un PSAH en relación al marco legal e institucional del país.
Los resultados muestran condiciones que es necesario considerar como requisitos previos a
la implementación de sistemas de PSAH en Chile. En efecto, los hallazgos señalan que el
marco legal e institucional en materia de recursos hídricos en el país, supone limitaciones.
Entre ellas se cuentan la dispersión de las distintas funciones que desarrolla el Estado en
materia de aguas, la falta de coordinación entre las políticas sectoriales y las de gestión de
los recursos hídricos y la importante cantidad de usos consuetudinarios y de derechos
antiguos de aprovechamiento de aguas, que no están inscritos en los Registros de Aguas.
Los resultados también indican que existen elementos que brindarían viabilidad o
potenciarían el éxito del funcionamiento de un PSAH, por ejemplo, el que la Constitución
Política de Chile reconozca los derechos sobre las aguas y que a su vez el Código de Aguas
establezca sus condiciones y características específicas constituye un ejemplo y una de las
evidencia más destacables de la potencial viabilidad que confiere el marco legal chileno a la
implementación de un PSAH.
Por lo tanto, atendidas las limitaciones identificadas, es posible concluir que sería viable
(desde el punto de vista legal e institucional) la implementación de un sistema de PSAH en
el país. / In Latin America the implementation of systems of payment for environmental services
(PES) extends as an innovative instrument to finance the conservation of nature and the
good management of natural resources. However, even arises as a new tool of
environmental management where local variables may determine his potential success, so
there are multiple recommendations and challenges to improve them.
Since in Chile the interest in this tool has been lower, it is considered relevant and
necessary to tackle the study of the PES in general, and watershed PES in particular
(PESH), through the identification and synthesis of the previous requirements that are
necessary to implement them in the country.
For this purpose, the present work was divided in three stages. The first step was to analyze
and synthesize literature on PES schemes, using the theoretical method of "Analysis and
synthesis", which allowed us to identify the conditions and elements which influence the
implementation of a PES. In the second stage, I reviewed the legal and institutional
framework related to water resources in Chile and the relevant requirements identified at
the previous stage were selected. Finally, in the third stage were synthesized the findings
that may limit the viability or feasibility of implementation of a PES in relation to the legal
and institutional framework of the country.
The results show that there are prerequisites for the implementation of systems of PESH in
Chile. Indeed, the findings indicate that the legal and institutional framework in the field of
water resources has limitations, which include the dispersion of functions developed by the
State on water issues, the lack of coordination between sectoral policies and the
management of water resources and the significant amount of uses and old water property
rights are not registered in the records of waters. Likewise, the results also indicate that
there are elements that would provide viability or boost the success of the operation of a
PESH, for example, that the Constitution politics of Chile recognizes water property rights
and the specific characteristics are laid down by the Water Code is an example and one of
the most noteworthy evidence about the potential viability which confers the Chilean legal
framework to the implementation of a PES.
Therefore, addressed the identified limitations, it is possible to conclude that it would be
advisable and viable implementation of a PESH in the country.
