Le contrat de transport de marchandises constitue l’un des grands contrats commerciaux. Permettant le développement des échanges commerciaux internes et internationaux, il fait l’objet d’une réglementation dense qui témoigne de son incidence sur l’économie et de la pluralité de modes de transport existant. Les différents textes légaux applicables mettent en exergue la volonté des rédacteurs de régler les étapes de la vie de ce contrat afin de créer un équilibre dans la relation entre le transporteur professionnel et son cocontractant. Toutefois, la particularité de ce domaine rend la tâche ardue, et cela en particulier lors de la réparation résultant de l’inexécution contractuelle du transporteur. Apparaît la question de l’équilibre indemnitaire. L’équilibre indemnitaire vise de prime abord, une identité entre le dommage subi par la victime et la réparation allouée. Cette définition connaît déjà des réserves face à une réparation limitée dans le temps et dans son montant, contrebalançant la responsabilité contractuelle de plein droit du transporteur professionnel. Une analyse approfondie de cette définition est nécessaire invitant à envisager son extension afin qu’elle corresponde davantage à la réalité du droit des transports de marchandises. Dès lors, le seul assouplissement de la définition de l’équilibre indemnitaire suffit-il à le garantir ? L’étude de ce concept appelant à la détermination de son existence dans le domaine du transport fait apparaître des insuffisances. Des outils sont alors introduits visant la sauvegarde voire le rétablissement de l’équilibre indemnitaire. Développée tant dans le domaine des transports qu’en droit commun des contrats, l’application de ces outils encourage le traitement du lien entre ce droit spécial et le droit commun afin d’offrir aux parties une solution juste et adaptée, facilitant la poursuite de leur relation commerciale. / The transport contract of goods is one of the major commercial contracts. This contract enables the development of local and international trade and is subject to tight regulation that reflects, on the one hand its impact on the economy and on the other hand of the plurality of existing modes of transport. The various effective legislations highlight the will of the drafters to regulate the stages of the duration of this contract in order to create a balance in the relationship between the professional carrier and the co-contractor. However, the particularity of this field makes the work complicated and this, especially during the reparation which results from the contractual nonperformance of the carrier. There appears the question of compensatory equilibrium. The compensatory equilibrium aims, at first sight, to guarantee a same identity between the damage which the victim has suffered and the reparation of this damage. This definition is already subject to reservations in the case of a limited compensation in time and in the amount offsetting the contractual liability of the professional carrier. An in-depth analysis of this definition is necessary to consider its extension so that it might correspond more closely to the reality of the law of the transport of goods.Therefore, can the relaxing of the definition be enough to guarantee the equilibrium indemnity? The study of this concept, which existence in the field of transport is to be determined, reveals deficiencies. Tools are therefore introduced to guarantee or even restore the compensatory equilibrium. These tools are as well developed in the field of transport as well as in contract law. Their enforcement encourages the treatment of the link between this special law and the contract law in order to offer the parties a fair and adapted solution which would make the continuation of the business relation easier.
