Previous issue date: 2016-08-11 / Uma vez positivados nas constitui??es os direitos fundamentais, o desafio da atualidade
refere-se ? concretiza??o destes direitos no mundo dos fatos. Com o desiderato de conferir
efic?cia social aos direitos fundamentais e superar os obst?culos ao projeto constitucional de
transforma??o da realidade social, surgiu o Minist?rio P?blico brasileiro contempor?neo. O
salto paradigm?tico de procurador do rei a defensor da sociedade ocorreu gradativamente com
o evolver hist?rico e foi consolidado na Constitui??o de 1988 que, ao eleger princ?pios e
valores fundamentais para que o Estado Democr?tico de Direito fosse consagrado, escolheu o
Minist?rio P?blico para defender a ordem jur?dica em prol da sociedade. Assim, na busca de
suplantar este estado de coisas e conferir verdadeira efetividade a tais direitos, o constituinte
de 1988 alterou radicalmente o perfil institucional do Minist?rio P?blico, definindo-o no
artigo 127 como institui??o permanente, essencial ? fun??o jurisdicional do Estado,
incumbindo-lhe a defesa da ordem jur?dica, do regime democr?tico e dos interesses sociais e
individuais indispon?veis. Com a an?lise da evolu??o do Minist?rio P?blico no Brasil buscase
demonstrar a ampla legitima??o social que a institui??o encontra entre n?s, sobretudo pelo
exame dos trabalhos desenvolvidos por ocasi?o da Assembleia Nacional Constituinte de
1987/1988. Ocorre que o Minist?rio P?blico brasileiro n?o surgiu aos constituintes
repentinamente e de forma improvisada, mas resultou de um processo extenso que visava dar
ao pa?s uma institui??o que o servisse, que fosse baluarte da democracia e da cidadania, n?o
mais preposta do Estado, em atendimento ?s demandas e conclames da sociedade brasileira
largamente reprimida por anos de ditadura. O Minist?rio P?blico tornou-se, ent?o, uma
institui??o constitucional muito atrelada aos fundamentos e objetivos da Rep?blica Federativa
do Brasil, como a cidadania, a dignidade da pessoa humana e a promo??o do bem de todos.
Ao mesmo passo que a Carta Cidad? outorgou miss?es t?o importantes ? institui??o
ministerial, conferiu-lhe tamb?m caracter?sticas e prerrogativas id?nticas aos Poderes
constitu?dos do Estado para que bem se desincumbisse de seu mister, o que deu azo ao
entendimento de renomados juristas que se trataria o Minist?rio P?blico brasileiro de um
quarto Poder do Estado. Nesse contexto, a an?lise da teoria dos poderes do Estado demonstra
que o poder estatal ? uno e indivis?vel, sendo pass?vel de divis?o apenas as fun??es do Estado,
quais sejam: de legislar, administrar, julgar e fiscalizar. E, n?o obstante tenha havido proposta
de cria??o de um ?rg?o novo e espec?fico para a defesa do povo durante a Constituinte, esta se
revelou bastante pragm?tica e optou por atribuir ao Minist?rio P?blico tal fun??o, sobretudo
porque a institui??o ministerial j? vinha exercendo esta atribui??o no mundo f?tico, dentro das
possibilidades do respectivo contexto jur?dico-pol?tico. A pesquisa em ep?grafe demonstra que
o Minist?rio P?blico brasileiro n?o ? um poder do Estado, mas possui status de poder para
lograr ?xito na defesa da sociedade, defesa esta que somente ser? efetiva se priorizado o vi?s
resolutivo em detrimento do demandista. / Fundamental rights are once positivized in constitutions, the nowadays challenge relates to
the implementation of these rights in the world of facts. With the desideratum to check social
efficiency to fundamental rights and overcome the obstacles to the constitutional project of
transformation of social reality, it emerged the contemporary Brazilian Minist?rio P?blico.
The paradigmatic jump champion at the king's attorney society occurred gradually with the
historical evolver and was consolidated in the Constitution 1988, to elect the fundamental
principles and values for the democratic rule of law was established, he chose the prosecutor
to defend the order legal for society. Thus, in seeking to overcome this state of affairs and
give real effect to these rights, the constituent 1988 radically altered the institutional profile of
the prosecution, defining it in Article 127 as a permanent institution, essential to the
jurisdictional function of the State, to defend the legal order, the democratic regime and social
and individual interests. With the analysis of the evolution of the Minist?rio P?blico in Brazil
it seeks to demonstrate the broad social legitimacy that the institution has among us,
especially the examination of the work developed during the National Constituent Assembly
of 1987/1988. Nevertheless, the brazilian Minist?rio P?blico did not appear suddenly and
improvised way, but constituents as a result of an extensive process aimed at giving the
country an institution to serve him, which were bulwark of democracy and citizenship, not
representative of State, in compliance the demands of Brazilian society largely repressed by
years of dictatorship. The prosecutor became then the constitutional institution more tied to
fundamental objectives of the Federative Republic of Brazil, such as citizenship, human
dignity and the promotion of the common good. At the same time the Citizen Charter granted
such important missions to ministerial institution, it also gave features and identical privileges
to state constituted powers so well if hold function, which has led to the understanding of
renowned jurists who treat the Brazilian Minist?rio P?blico of fourth state power. In this
context, it analyzes the theory state powers demonstrating that the state power is one and
indivisible, being subject to division only state functions, namely: to legislate, administer,
adjudicate and enforce. And yet there has been proposed to create a new separate body for the
defense of the people during the Constituent Assembly, this proved to be highly pragmatic
and chose to assign to the prosecutor this function, especially since the ministerial institution
was already performing this assignment in world factual, within the possibilities of the legal
and political context. Aims to demonstrate to the survey title that the Brazilian Minist?rio
P?blico is not a power of the state, but has power status to do successful defense of society,
defending this will be effective only if prioritized resolving to the detriment of request.
