Previous issue date: 2014-07-30 / This thesis has the goal the search for mechanisms that have the possibility to provide an effective protection to the fundamental right of the environment in the work place (environment), using as north the range of the harmonic right to an healthy and balanced environment combined with the social and work rights expressed in the Brazilian constitution. To begin with, we searched a way to demonstrate the necessity of this protection in front of the today s situation of the workers, which are exposed to lots of risks in this new modern way of production that is determined by the market economy. From this first panorama, this paper will try to demonstrate the path of the social rights conquer as well as the healthy environment rights, focusing the approach on their fundamental rights status in the Brazilian Constitution that is the theme of our first chapter. At the second chapter, we hope to point the elements in our national law order (although they have international law sources), and how they manage to protect the fundamental rights. The analysis of this instruments will due in three parts; the first one is to range the regulations that object to protect the work environment. After, it will be made an identification of the manners en employer can be responsible in cases of moral harassment, work accidents and unhealthy work place. At the end, having in mind the principles of Environmental Law the prevention principle , we propose a constitutional interpretation of the article 160 of the CLT, whose objective is to inspect the work places that can cause risks to the health of security of the workers. From this legal instrument, we question the possibility of an effective damage prevention caused in the work place environment, reaching the protection of this fundamental right. / Este trabalho tem por objetivo a busca de mecanismos que tenham a possibilidade de realizar uma efetiva tutela do direito fundamental ao meio ambiente equilibrado no ?mbito do (meio ambiente do) trabalho, norteando-se pelo alcance efetivo do direito ao meio ambiente harm?nico e equilibrado e os direitos sociais trabalhistas expressados no texto constitucional. Primeiramente, buscar-se-? demonstrar a necessidade desta tutela diante da atual situa??o do trabalhador, sujeito a diversos riscos inerentes ao novo modelo de produ??o estabelecido pela economia de mercado. A partir deste panorama, o presente trabalho visa a demonstrar a maneira com que se deu a conquistas dos direitos sociais trabalhistas e de um meio ambiente equilibrado, bem como apontar seu status de direito fundamental na Constitui??o Federal, o que ser? exposto no primeiro cap?tulo. Pretende-se, ainda, no segundo cap?tulo, apontar elementos no ordenamento jur?dico p?trio (ainda que tenham por fonte regula??es de entidades internacionais) que t?m por objetivo efetivar este direito fundamental. A an?lise destes instrumentos dar-se-? em tr?s etapas; a primeira elencando as principais normas que visam a proteger o ambiente de trabalho. Depois, ser? feita a identifica??o dos modos de responsabiliza??o ao empregador em casos de ass?dio, acidentes de trabalho e local de trabalho insalubre. Por fim, basilando-se pelos princ?pios reguladores do Direito Ambiental mormente o princ?pio da preven??o, prop?e-se uma interpreta??o constitucional do art. 160 da CLT, cujo objetivo ? justamente inspecionar instala??es que podem gerar riscos ? sa?de e ? seguran?a do trabalhador. A partir deste dispositivo legal, questiona-se a possibilidade de uma efetiva preven??o a danos causados no meio ambiente do trabalho, concretizando-se, assim, a efetiva tutela deste direito fundamental.
