El presente trabajo está dirigido a profundizar en la calificación registral de actos
administrativos fictos de conformidad de obra y declaratoria de fábrica; en vistas que la
evaluación del acto administrativo ficto en sede registral ha sobrepasado lo dispuesto por
el pleno N° 93, precedente segundo: “Calificación de actos administrativos” y el pleno
N°100, precedente único: “Aplicación del silencio administrativo positivo”.
Con ello en mente se realiza una sucinta descripción del instituto del silencio
administrativo positivo( en adelante “SAP”) desde la Ley N° 290901, Ley de regulación
de habilitaciones urbanas y edificaciones y sus Reglamentos (en adelante la “Ley N°
29090”) para luego continuar con el fondo del trabajo académico que es el análisis de la
normativa registral, precedentes de observancia obligatoria pertinentes y diversas
resoluciones emitidas por los tribunales registrales con el objetivo de poder reconocer los
retos que presenta la calificación de un acto ficto o presunto de conformidad de obra y
declaratoria de fábrica, para elaborar posibles reformas.
En este trabajo se han logrado desarrollar 4 retos en la calificación registral de los actos
fictos de declaratoria fábrica y recabar la tendencia actual en la resolución de dichos retos
a través de los tribunales registrales. / The present paper aims to address the registry qualification of fictional administrative
acts of conformity of work and declaration of factory; being that the evaluation of the
fictitious administrative act in the registry office has exceeded the provisions of plenary
session No. 93, second precedent: "Qualification of administrative acts " and plenary
session No. 100, sole precedent: "Application of positive administrative silence".
With this in mind, a brief description of the institute of positive administrative silence
will be made from Law No. 29090, Law for the regulation of urban authorizations and
buildings and its Regulations (hereinafter "Law No. 29090") and then continue with the
core of the academic work that is the analysis of the registration regulations, the
precedents of mandatory observance mentioned above and the resolutions issued by the
registry courts with the aim of being able to recognize the challenges presented by the
qualification of a fictitious or presumed act of conformity of work and declaration factory,
to develop possible reforms.
Consequently, the present work has managed to develop 4 challenges in the registration
qualification of fictitious acts of factory declaration and analyze the current trend in which
said challenges are resolved through the registry courts. / Trabajo académico
