Previous issue date: 2011 / This study analyzes the possibility of using consensual mechanisms as a way of composition of conflicts involving the Public Administration in the rendering of Public Services. Therefore, in the beginning the different ways of rendering public services used by the State will be studied. Thereafter, we will reflect about the authoritarian way the Public Administration establishes the regulations due to the compliance of the supremacy of the official interest over the private one, verifying the possibility of the relavitization, or even the weighting of this principle. Besides, the interests of the Public Administration will be studied as well as the types of public interest and the compatibility between the public and private interest. Finally, within the core of the study, it will be possibile to conclude about the possibility of using the consensuality aiming at settling disputes between the Public Administration and the private sector, showing the various forms of manifestation of this institute in the Modern Public Administration and addressing also the advantages and disadvantages. / O presente trabalho analisa a possibilidade de utilização de mecanismos consensuais como forma de composição de conflitos envolvendo a Administração Púbica na Prestação de Serviços Públicos. Para tanto, inicialmente, serão estudadas as várias formas de prestação de serviços públicos utilizadas pelo Estado. Posteriormente, será feita uma reflexão a respeito da forma autoritária da Administração Pública com a qual edita seus atos devido à observância estrita da supremacia do interesse público sobre o privado, verificando a possibilidade da relativização, ou mesmo, da ponderação deste princípio. Além disso, serão estudados os interesses da Administração Pública e suas características, bem como as espécies de interesse público e a compatibilidade entre o interesse público e o interesse particular. Por fim, chegando ao cerne do trabalho, será possível concluir acerca da possibilidade da utilização da consensualidade com o fim de dirimir controvérsias entre a Administração Pública e o particular, demonstrando as várias formas de manifestação deste instituto na Administração Pública Moderna e abordando ainda suas vantagens e desvantagens.
