Defesa: Curitiba, 12/06/2015 / Inclui referências : f. 99-105 / Resumo: A presente pesquisa objetivou identificar os modos como o psicólogo que atua no sistema de justiça configura sua prática em seu discurso. A perspectiva metodológica adotada para a realização deste estudo foi a análise institucional do discurso. Os dados foram obtidos por meio de entrevistas individuais com seis psicólogos que atuam em órgãos componentes do sistema de justiça dos estados do Paraná e de Santa Catarina, dentre eles a Polícia Civil, o Ministério Público, o Poder Judiciário e a Defensoria Pública. Evidenciou-se nas análises inúmeros embates quanto às práticas da Psicologia junto ao Direito, nas quais as demandas advindas do campo jurídico mostraram-se conflitantes com o que se propõe, principalmente nos manuais do conselho de classe, ser uma atuação ética em Psicologia. Os psicólogos mostraram não ter clareza sobre a delimitação de sua clientela, o que os deixava, não raras vezes, em dúvidas sobre a quem deveriam servir, se ao sistema de justiça ou se à pessoa a quem atendiam. A fim de configurar seu objeto, e legitimar-se como instituição por meio das práticas que se repetiam na ação cotidiana dos psicólogos no contexto da Justiça, a Psicologia ali mostrou-se reivindicando a posse de um objeto institucional: a verdade. Para isso, nos discursos dos participantes, apareceu a desapropriação do operador do direito desse objeto, na medida em que, segundo os entrevistados, só poderia ser acessado pelo psicólogo. Este, por sua vez, apresentou-se constituído por diversos poderes, dentre os quais, ele teria um olhar clínico que mostraria ao sistema de justiça aquilo que os operadores do direito não conseguiriam enxergar. Assim, para surpresa das pesquisadoras, evidenciou-se que a verdade não era o que almejava somente o operador do direito, mas o psicólogo também. Nesse sentido, falamos da configuração de um psicólogo jurídico que, por meio de um olhar clínico, de um conhecimento de linguagens, de uma condição de acessar o mundo interno das pessoas, credita a si a possibilidade de descobrir verdades e, assim, instrumentalizar o sistema de justiça para que este possa tomar as decisões. Olhar clínico. / Abstract: The present research aimed to identify the ways in which the psychologist working in the justice system configures his practice in his discourse. The methodological perspective adopted for this study was the institutional discourse analysis. The data were obtained through individual interviews with six psychologists who work in components of the justice system of the states of Paraná and Santa Catarina, among them the Civil Police, the Public Prosecutor's Office, the Judiciary and the Public Defender's Office. It was evident, in the analysis, there were numerous obstacles to the practice of Psychology in Law, in which the demands arising from the legal field were conflicting with what is proposed, especially in the manuals of the class council, to be an ethical action in Psychology. Psychologists showed that they were not clear about the delimitation of their clientele, which often left them in doubt as to who they should serve, whether to the justice system or to the person they attended. In order to configure its object, and to legitimize itself as an institution through the practices that were repeated in the daily action of psychologists in the context of Justice, the juridical psychology there showed itself to be claiming the possession of an institutional object: the truth. For this, in the participant's speeches appeared the expropriation of the operator of the law of this object, in the measure that, according to the interviewees, could only be accessed by the psychologist. This, in turn, presented itself constituted by diverse powers, among which, it would have a clinical look that would show to the justice system what the operators of the law could not see. Thus, to the surprise of the researchers, it was evident that the truth was not what only the operator of the law wanted, but the psychologist as well. In this sense, we speak of the configuration of a legal psychologist who, through a clinical look, a knowledge of languages, a condition of accessing the inner world of people, credits himself to the possibility of discovering truths and, thus, system of justice so that it can take decisions.
