Previous issue date: 2017-06-29 / The Convention on the Rights of Persons with Disabilities and the Disabled Persons Statute promoted significant changes in the treatment of persons with mental and intellectual disabilities by placing them on an equal footing with other persons and recognizing their full legal capacity. It is important to say that disability is no longer a rule, but an exception. In this perspective, the autonomy of the person with psychic and intellectual disability, especially regarding the existential acts of life, must be preserved and promoted, as established by these instruments. The present study aims to analyze the corporal autonomy of the person with psychic and intellectual disability in cases that involve compulsory sterilization - a mechanism that is prohibited by the afore mentioned documents, but admitted by the Family Planning Law. To do so, we first describe the changes made in the civil capacity institute by the different models of approach to understand the treatment of people with mental and intellectual disabilities with the advent of the Disabled Persons Statute (Law 13,146 / 2015). The full legal capacity of the mentally and intellectually disabled person recognized by the United Nations Convention on the Rights of Persons with Disabilities, as well as the Disabled Persons Statute, is then examined to in the full exercise of their existential rights. Finally, the decisions of compulsory sterilization exist in the Courts of Justice of the Federation, to demonstrate how the jurisprudence has been positioning on the protection of the corporal autonomy of the person with psychic and intellectual disability. Through a bibliographical and documentary research, it is intended to demonstrate to society, the family, and the State that people with psychic and intellectual disabilities have autonomy and freedom to make decisions. In addition, it determines that all, jointly, assist in the construction of the free development of their personality, in this work, manifested by the right to decide on the conservation or not of their fertility. It is concluded that compulsory sterilization practices must be prohibited to respect and guarantee the full exercise of the civil capacity of the mentally disabled for existential acts.

Compulsory Sterilization. / A Convenção sobre os Direitos das Pessoas com Deficiência e o Estatuto da Pessoa com Deficiência promoveram significativas mudanças no trato com a pessoa com deficiência psíquica e intelectual ao colocá-las em patamar de igualdade com as demais pessoas, bem como reconhecer a sua capacidade jurídica plena. Importa dizer que a incapacidade não é mais regra, e sim exceção. Nessa perspectiva, a autonomia da pessoa com deficiência psíquica e intelectual, principalmente no tocante aos atos existenciais da vida, deve ser preservada e promovida, conforme estabelecem os referidos instrumentos. O presente trabalho visa analisar a autonomia corporal da pessoa com deficiência psíquica e intelectual nos casos que envolvem a esterilização compulsória ¿ mecanismo este vedado pelos documentos acima mencionados, porém admitido pela Lei de Planejamento Familiar. Para tanto, primeiramente, descrevem-se as mudanças havidas no instituto da capacidade civil pelos diversos modelos de abordagem, para compreender o tratamento dispensado à pessoa com deficiência psíquica e intelectual pelo advento do Estatuto da Pessoa com Deficiência (Lei n° 13.146/2015). Em seguida, examina-se a capacidade jurídica plena da pessoa com deficiência psíquica e intelectual reconhecida pela Convenção sobre os Direitos das Pessoas com Deficiência da Organização das Nações Unidas, bem como pelo Estatuto da Pessoa com Deficiência, a fim de observar se de fato se encontram no pleno exercício dos seus direitos existenciais. Por fim, apresentam-se as decisões de esterilização compulsória existentes nos Tribunais de Justiça da Federação, a fim de demonstrar como a jurisprudência vem se posicionando a respeito da proteção da autonomia corporal da pessoa com deficiência psíquica e intelectual. Por meio de uma pesquisa bibliográfica e documental, pretende-se demonstrar à sociedade, à família e ao Estado que as pessoas com deficiência psíquica e intelectual possuem autonomia e liberdade para a tomada de decisões. Além disso, determina que todos, conjuntamente, auxiliem na construção do livre desenvolvimento da sua personalidade, neste trabalho, manifestado pelo direito de decidir a respeito da conservação ou não da sua fertilidade. Conclui-se que as práticas de esterilização compulsória devem ser vedadas, a fim de respeitar e garantir o pleno exercício da capacidade civil das pessoas com deficiência psíquica e intelectual para atos existenciais.
