Previous issue date: 2017-11-27 / This thesis deals with the investigation of the position of the subject of desire in the fulfillment of the socio-educational measure in an open environment, starting from the assumption that the institution represents a privileged setting of encounter between the subject of right, that emphasizes the citizen and of the subject of desire that emphasizes the intervention of the unconscious in the social bond. Based on work as a psychologist in a public institution, where the subject of law is a strong reference, it was possible to take as a research objective to investigate how institutional intervention appropriates the characteristics of the subject of desire and, as this affects the fulfillment of the measure socioeducativa (MSE) in an open environment. To achieve this, the research that was carried out was of a qualitative nature, with bibliographical, documentary and field research. The theoretical reference counted on the concepts of law, social bond, malaise, desire, symptom and ethics in the light of psychoanalysis. The methodological approach was based on bibliographical research, when authors were asked to discuss the object of the investigation, followed by documentary research, when the collection of objective data was carried out together with the records of adolescents followed up, and finally, given the importance of the subjective aspect, field research was performed when two adolescents who met PSC and LA were interviewed and offered rich material for analysis. The research had a sample of situations experienced in the fulfillment of MSE in an open environment, in the year 2014, in the Specialized Reference Center for Social Assistance - CREAS, in the municipality of Maracanaú-Ce. From the course carried out, it was possible to verify that in the MSE in an open environment, the subject of law has space secured, since the institutions responsible for
compliance with the measure justify their actions based on the imposition of the legal norm, while the subject of desire , although visibly neglected by the government, insists on interfering in the implementation of the MSE in an open environment, showing itself repeatedly in the desired manifestations of those who lead the social bond.
Keywords: Socio-educational Measure, Psychoanalysis, Desire, Right, Subject. / Esta Tese trata da investigação da posição do sujeito de desejo no cumprimento da medida socioeducativa em meio aberto, partindo do pressuposto de que a instituição representa um cenário privilegiado de encontro entre o sujeito de direito, que enfatiza o cidadão e, do sujeito de desejo que ressalta a intervenção do inconsciente no laço social. Com base no trabalho como psicóloga em uma instituição pública, onde o sujeito de direito é forte referência, foi possível tomar como objetivo da pesquisa, investigar como a intervenção institucional se apropria das características do sujeito de desejo e, como isso repercute no cumprimento da medida socioeducativa (MSE) em meio aberto. Para o alcance desse intento, a pesquisa que se efetivou foi de natureza qualitativa, com investigação bibliográfica, documental e de campo. A referência teórica contou com os conceitos de lei, laço social, mal estar, desejo, sintoma e ética à luz da psicanálise. O percurso metodológico partiu da pesquisa bibliográfica, quando autores foram chamados a dialogar sobre o objeto da investigação, seguida da pesquisa documental, quando a coleta de dados objetivos foi realizada junto aos prontuários dos adolescentes acompanhados, e por fim, dada importância do aspecto subjetivo, foi realizada a pesquisa de campo, quando dois adolescentes que cumpriram PSC e LA foram entrevistados e ofereceram rico material de análise. A pesquisa contou com uma amostra de situações vivenciadas no cumprimento da MSE em meio aberto, no ano de 2014, no Centro de Referência Especializado da Assistência Social - CREAS, do município de Maracanaú-Ce. Do percurso realizado, foi possível a constatação de que na MSE em meio aberto, o sujeito de direito tem espaço assegurado, vez que as instituições encarregadas do cumprimento da medida justificam suas ações com base na imposição da norma
legal, enquanto que o sujeito de desejo, apesar de visivelmente negligenciado pelo poder público, insiste em interferir na efetivação da MSE em meio aberto, se mostrando reiteradas vezes nas manifestações desejantes dos que protagonizam o laço social.
