Previous issue date: 2010-05-31 / been published as books, magazines, loose, and press materials available on the Internet, and documentary projects through, doctrines, laws, rules, resolutions, research online, decisions of the Superior Courts Brazilians, among others dealing on the subject, as well as participation in the author's most recent National Congress of ANDES-SN held in Salvador - BA. The end of the seventeenth century ended a historical period marked by legal uncertainty. The eighteenth century coincided with the Industrial Revolution, a movement that showed the need for social awareness on the rights of human beings as citizens and employees. After the 2nd World War, the feeling of freedom and democracy was further strengthened. In Brazil, with advent of the Federal Constitution of 1988, the company witnessed the democratization of the workers took advantage of this historic moment to organize and form unions for the purpose lidima to ensure the materialization of the rights constitutionally expressed, particularly in relation to
social rights. Following the evolutionary pace of employment gains throughout the country, in 1981 was created the National Association of Teachers of Higher Education - National Union. This thesis presents a study on the constitutional foundations and regulatory union organization of university teaching in Brazil, as well as comment on the legitimacy of the ANDES-SN and its performance for the achievement of rights with the scope to ensure the exercise worthy of teaching higher. We conclude that the ANDES-SN developed work of fundamental importance for the country's democratization and the consolidation of Brazilian democracy, and defend in tough education and its agents as fundamental social right.

ANDES-SN. / O presente trabalho em discussão utilizou pesquisa bibliográfica, investigativa e histórica na literatura jurídica já publicada em forma de livros, revistas, publicações avulsas, imprensa escrita e matérias disponibilizadas na internet; e documental, através de projetos, doutrinas, leis, normas, resoluções, pesquisas on line, decisões dos Tribunais Superiores brasileiros, dentre outros que tratem sobre o tema, bem como a participação do autor no mais recente Congresso Nacional do ANDES-SN realizado em Salvador BA. O final do século XVII encerrou um período histórico marcado pela insegurança jurídica. O século XVIII coincidiu com a Revolução Industrial, movimento que observou a necessidade de conscientização social sobre os direitos dos seres humanos enquanto cidadãos e empregados. Após a 2ª Guerra Mundial, o sentimento de liberdade e de democracia ficou ainda mais fortalecido. No Brasil, com o advento da Constituição Federal de 1988, a sociedade presenciou a redemocratização do país e os trabalhadores aproveitaram esse momento histórico para organizar e formar sindicatos com a finalidade lídima de garantir a materialização dos direitos constitucionalmente expressos, principalmente no tocante aos direitos sociais. Acompanhando o ritmo evolutivo de conquistas laborais por todo o País, no ano de 1981 foi criada a Associação Nacional dos Docentes do Ensino Superior Sindicato Nacional. A presente dissertação apresenta um estudo sobre os fundamentos constitucionais e normativos da organização sindical do magistério superior no Brasil, bem como tecer comentários sobre a legitimidade do ANDES SN e sua atuação para a conquista de direitos com o escopo de garantir o exercício digno do magistério superior. Conclui-se que o ANDES-SN desenvolveu trabalho de fundamental importância para a redemocratização do país e a consolidação da democracia brasileira, além de defender de forma intransigente a educação e seus agentes como direito fundamental social.
