Previous issue date: 2010-12-15 / This work deals with the possibility of guaranteeing the right to set up a family asset for homosexual couples as a means of protecting the right to housing. By using analogy of the legal effects of permanent union to homoafetiva union and the immediate application of the fundamental rights to equality, freedom and the principle of human dignity. The applicability of the fundamental rights guarantee the possibility of the Judicial Power to interfere because of the omission in the law about homoafetivas unions and the open structure of the article 226 of the Constitution allows for its inclusion in the models of family entities. The sexual orientation as a reflection of the human personality must be part of the general article of personal rights.

homossexuais, como meio de proteção ao direito à moradia. Isso por meio da equiparação,
por analogia dos efeitos jurídicos da união homoafetiva à união estável, e da aplicação
imediata dos direitos fundamentais à igualdade e à liberdade e do princípio da dignidade da pessoa humana. A auto-aplicabilidade dos direitos fundamentais garante a possibilidade de intervenção do Poder Judiciário diante da lacuna da lei em relação ao disciplinamento normativo das uniões homoafetivas, e o caráter aberto do artigo 226 da Constituição Federal permite a sua inclusão nos modelos de entidades familiares. A orientação sexual como reflexo da personalidade humana, deve fazer parte da cláusula geral dos direitos da personalidade.
