Previous issue date: 2011-08-22 / The copyrights reserve, among others aspects, the exclusive rights of the creator in the use, publication and reproduction of their literary, scientific and artistic creations, as the connected rights are responsible for the guarantees of the ones who, in some less direct form, had participated of the creation. Such rights are part of the copyright statute, currently, regulated by 9.610 Law, in February 19th of 1998, entitled by the Copyright Law (LDA), which guarantees the patrimonial matter, as the moral rights of the literary, scientific and artistic creation. The public use of an artistic work demands the payment of the authorial consideration, duly warned to infringe the Brazilian legislation, having to be applied to the defaulter many legal sanctions. To assist owners of such rights in the collection of their authorial repayment, the LDA, in respect to music, it kept the Collection and Distribution Central Office (ECAD), entity without lucrative ends, for the collection and distribution of the rights related to the public execution of the musical composition and phonograms, by the broadcasting and transmission of any modality, and by the exhibition of audiovisual work. Such institution is, currently, managed by nine associations of collective management of the
music copyrights. Several scandals have been raised, since 1995, against this philanthropic entity, culminating with the instauration of various Parliamentary Inquiry Commissions (CPI's). Therefore, by research in books, written essays/thesis, legislation, articles and specialized magazines, journalistic substances and periodicals published in the databases available, what it constitutes essential material for analysis of the board, subjected however to the present work to identify, among others aspects, collection and distribution s criteria of the copyrights for the public execution of music by the ECAD, as well as the justifications of main restored CPI' s against this entity.

Office (ECAD). / Os direitos autorais protegem, entre outros aspectos, a exclusividade dos autores na utilização, publicação e reprodução de suas criações literárias, científicas e artísticas. Já os direitos conexos são os responsáveis pela tutela das garantias dos que, de alguma forma menos direta, participaram dessa criação. Tais direitos fazem parte da propriedade intelectual e são, atualmente, regulamentados pela Lei 9.610 de 19 de fevereiro de 1998, intitulada Lei do Direito Autoral (LDA), a qual garante tanto a questão patrimonial, como a moral de uma criação literária, científica e artística. A utilização pública de uma obra artística exige o pagamento da contraprestação autoral, sob pena de infringir a legislação brasileira, devendo ser aplicadas ao inadimplente diversas sanções legais. Para auxiliar os titulares de tais direitos na cobrança de sua retribuição autoral, a LDA, no que diz respeito à música, manteve instituído o Escritório Central de Arrecadação e Distribuição (ECAD), entidade sem fins lucrativos, para a arrecadação e distribuição dos direitos relativos à execução pública das obras musicais e lítero-musicais e de fonogramas, inclusive por meio da radiodifusão e transmissão por qualquer modalidade, e da exibição de obras audiovisuais. Tal instituição é, atualmente, administrada por nove associações de gestão coletiva dos direitos autorais da música. Diversos escândalos têm sido levantados, desde 1995, contra essa entidade filantrópica, culminando, inclusive, com a instauração de diversas Comissões Parlamentares de Inquéritos (CPI s). Portanto, por meio de consulta a livros, dissertações/teses, legislação, artigos e revistas especializadas, matérias jornalísticas e consulta em sítios eletrônicos, o que constitui material essencial para análise do tema ora abordado, a presente dissertação busca identificar, entre outros aspectos, os critérios de arrecadação e distribuição dos direitos autorais pela execução pública da música pelo ECAD, bem como as justificativas das principais CPI s instauradas contra essa entidade.
