The objective is to analyze the Brazilian investigative model under the light of contradictory warranty. Contradictory as a guarantee that aims to protect legal equality between subjects involved in the preliminary investigation, applying the democratic foundations for the prosecution. The study was conducted through literature with analysis of scientific literature reference in the criminal law area, criminal procedure, constitutional law and human rights. The topic is current, because the Law 13.245 / 16 now allows the lawyer to participate in the interrogation of the investigation in any kind of investigation. Documentary research was
conducted in criminal cases acquis that go through in the criminal courts of Fortaleza
involving the theft crime with the aim of identifying the existence of contradiction in the police investigation and the implications for legal discovery. The study identified the divergence of scientific literature on the application of contradictory still in the research phase. In this context, the role of the Public Defender was analyzed as an institution capable of facilitating the exercise of the adversarial still in the investigation stage, promoting defensive criminal investigation and accountability of police activity, as powers conferred by Constitutional Amendment. 80 of 4 June 2014. With the deepening study there was the need for constitutional adequacy of the police investigation, being necessary legislative changes and implementation of the judge of guarantees.

O objetivo do trabalho é analisar o modelo investigatório brasileiro à luz da garantia do
contraditório. Contraditório como uma garantia que visa proteger a igualdade jurídica entre os sujeitos envolvidos na investigação preliminar, aplicando os fundamentos democráticos para toda persecução penal. O estudo ocorreu por meio de pesquisa bibliográfica com análise da literatura científica de referência na área do direito penal, processo penal, direito constitucional e direitos humanos. O tema abordado é atual, pois a lei 13.245/16 passou a permitir a participação de advogado no interrogatório do investigado, em qualquer tipo de investigação. Foi realizada pesquisa documental no acervo de processos criminais que tramitam em varas criminais de Fortaleza envolvendo o crime de roubo, com o escopo de identificar a existência do contraditório no inquérito policial e as implicações na instrução processual. O estudo permitiu identificar a divergência da literatura cientifica quanto à aplicação do contraditório ainda na fase investigativa. Nesse contexto, foi analisada a atuação da Defensoria Pública como instituição capaz de viabilizar o exercício do contraditório ainda
na fase investigatória, promovendo a investigação criminal defensiva e a accountability da atividade policial, consoante atribuições conferidas pela Emenda Constitucional n. 80, de 4 de junho de 2014. Com o aprofundamento do estudo, verificou-se a necessidade de adequação constitucional da investigação policial, fazendo-se necessária a alteração legislativa e implantação do juiz de garantias.
