Previous issue date: 2016-08-30 / The scope of this dissertational work is to present research on the confusion between religion and the current Brazilian secular state. Despite the cooperative model is desirable, it is found that the factual background overlap of Christian values at the expense of other religious beliefs. Therefore, before the unequal scenario, it is necessary to review the cases, judicial, political and legal. Recognizes the oceanic variety of matter, reducing the analysis in five cases after the promulgation of the Constitution of 1988. Having their choice, justified by the prevailing constitutional. For better understanding, has two introductory topics: the first, which analyzes the concept of religion, its relationship with the state and conceptual delimitation and forms of secular state. In the second, the historical evolution of the secular state by the Brazilian constitution. In the third and fourth chapter we analyze the relationship between religious education in public schools; Religious pluralism in the current political scenario; Religious Holidays; Blood transfusion in Jehovah¿s witnesses, Seventh-day Adventist to provide public tender. The methodological research approach can be characterized as qualitative was more prevalent rigorous examination of the nature, scope and possible interpretations of the studied phenomenon. As a result, there is the impossibility of cooperation between religions and the current Brazilian secular state and the need for the judiciary to ensure the religious freedom of the individual who professes belief minority.
Keywords: Secular state; Religious freedom; Secularization; Secularity; Secularism / O escopo deste trabalho dissertativo é apresentar pesquisa quanto à confusão entre religião e o atual Estado laico brasileiro. Apesar do modelo cooperativo ser o desejável, verifica-se que no plano fático há sobreposição dos valores cristãos em detrimento das demais crenças religiosas. Portanto, diante do cenário desigual, torna-se necessário que se analise os casos, jurisdicionais, políticos e legais. Reconhece-se a variedade oceânica da matéria, reduzindo a análise em cinco casos após a promulgação da Constituição de 1988. Tendo a respectiva escolha, justificada pela predominante natureza constitucional. Para melhor entendimento, tem-se dois tópicos introdutórios: o primeiro, que analisa o conceito de religião, sua relação com o Estado e delimitação conceitual e as formas de Estado laico. No segundo, a evolução histórica do Estado laico pelas constituições brasileiras. No terceiro e quarto capítulo analisamos, as relações entre o ensino religioso nas escolas da rede pública; O pluralismo religioso no atual cenário política; Feriados religiosos; Transfusão de sangue em testemunhas de Jeová e por fim, O candidato adventista do sétimo dia ao prestar concurso público. O enfoque metodológico da pesquisa pode ser caracterizado como qualitativo, preponderando o exame rigoroso da natureza, do alcance e das interpretações possíveis para o fenômeno pesquisado. Como resultado tem-se a impossibilidade de cooperação entre as religiões e o atual Estado laico brasileiro e a necessidade de o poder judiciário assegurar a liberdade religiosa do indivíduo que professa crença minoritária.
