Previous issue date: 2012-05-28 / This paper aims to investigate how adequate is the protection system in Brazilian Law when it comes to legal relationships established over the internet, from a point of view of the Law as a set of rules and principles.
The new technologies, the thirst for information, and the enchantment of the new ways for acquiring knowledge - bring to the individuals answers and solutions to their needs, by means of alternative approaches ruled by principles, traditions and experiences others than those from their usual surrounding reality.
The intention is to capture the attention of the family, society and public institutions to review the foundations concerning education, protection against violence and threats to the rights of the personality in special the family privacy in the internet given the digital ignorance of some users and the lack of ethical and moral principles of others.
Given the revolution we observe in information technology and the astonishing agility of the change in the worldwide scenario, the private life of ordinary people started taking part in this scene, with unimaginable consequences and thus deserving our attention towards a fundamental objective: the preservation of the family privacy as a major factor concerning the respect to the superior principle of dignity of the human being / O presente trabalho tem como objetivo investigar até que ponto, no direito brasileiro, o sistema de proteção mostra-se adequado às relações jurídicas praticadas pela internet, a partir de uma visão do direito como um conjunto de normas e princípios.
As novas tecnologias, a sede de informações e o deslumbramento com inovadores rumos na aquisição de conhecimento, faculta a cada indivíduo a busca de respostas e soluções para suas necessidades a partir de realidades cujas condutas são regidas por princípios, tradições e experiências outras que não as de seu mundo circundante.
A intenção é conclamar a família, a sociedade e o poder público para revisar as tarefas fundamentais no tocante à educação, a proteção frente à violência, as ameaças e os perigos crescentes aos direitos da personalidade, notadamente a privacidade familiar na internet, pela ausência de conhecimento por parte de alguns usuários e de princípios éticos e morais por outros.
Sendo assim, com a revolução da tecnologia da informação, e a rapidez assustadora com que as transformações vêm se sucedendo no cenário mundial, a vida privada das pessoas comuns passou a ser parte integrante deste cenário, com consequências inimagináveis, merecendo a união de todos em prol de um objeto fundamental: a preservação da privacidade familiar, como fator preponderante de respeito ao superior princípio da dignidade da pessoa humana
