O presente trabalho examina a imunidade tributária dos partidos políticos e de suas fundações, prevista no art. 150, VI, “c”, e § 4º, da Constituição Federal, investigando sua natureza, fundamentos e alcance, a fim de demonstrar que não comporta a interpretação ampliativa utilizada pelo Supremo Tribunal Federal no tocante às imunidades em geral. Para tanto, ressalta-se a sua natureza instrumental, de garantia ao exercício da cidadania; sua excepcionalidade frente ao dever fundamental de pagar impostos; sua necessária vinculação às finalidades essenciais dos partidos políticos e fundações partidárias; a necessidade de se adotar interpretação que considere os demais direitos fundamentais por ela afetados, como por exemplo os direitos econômicos, e que além disso avalie sua eficácia no plano real, de modo a descobrir se realmente atinge seu propósito garantista, se é ineficaz, ou se configura um privilégio contrário à igualdade tributária. / This paper examines the tax immunity of political parties and their foundations, provided for in art. 150, VI , “c” , and § 4 of the Federal Constitution, investigating their nature, rationale and scope in order to demonstrate that it doesn't entail the ampliative interpretation used by the Supreme Court concerning immunities in general. Therefore, we emphasize its instrumental nature, as a guarantee to the exercise of citizenship; an exceptionality towards the fundamental duty to pay taxes; its necessary bond to the essential purposes of political parties and party foundations; the need to adopt the interpretation that considers the other fundamental rights affected by it, such as economic rights, and also evaluate its effectiveness in a real plan in order to find out if really reaches its right assuring purpose, If it is ineffective, or configuring a privilege contrary to tax equality.
