Previous issue date: 2015-11-23 / CAPES - Coordenação de Aperfeiçoamento de Pessoal de Nível Superior / O presente trabalho visa produzir uma crítica à manutenção do paradigma do conhecimento e da hermenêutica tradicional como principal pressuposto de interpretação da racionalidade jurídica. Após pesquisa documental foram analisadas decisões definitivas do Poder Judiciário Paraense (acórdãos e sentenças) sobre o direito à terra, pelo que verificou-se como este fato concorre paradoxalmente para com a insegurança jurídica e o acúmulo de demandas no Poder Judiciário, haja vista que, muitas vezes, a utilização do paradigma do conhecimento, no âmbito da hermenêutica tradicional, contribui para com o encerramento do processo sem resolução de mérito, devolvendo o problema à sociedade ou para com a eleição arbitrária de princípios e métodos interpretativos, que, por sua vez, ocasionam decisões divergentes para casos semelhantes. Dessa forma, a pesquisa apresenta uma reflexão sobre o direito à terra no Estado do Pará sob o aspecto histórico e social e uma análise das decisões judiciais definitivas sobre este direito a luz das teorias hermenêuticas, apresentando uma nova proposta para hermenêutica, denominada hermenêutica jurídica Agroambiental e pautada no paradigma da filosofia da linguagem, como um instrumento a favor da efetividade e contra a arbitrariedade na aplicação do direito à terra. / This work aims to produce a critical maintenance of the knowledge paradigm and traditional hermeneutics as main assumption of interpretation of legal rationality. After desk research were analyzed final decisions of the judiciary Paraense (judgments and sentences) on the right to land, so it was like this fact has contributed paradoxically to the legal uncertainty and the accumulation of demands on the judiciary, given that often using the paradigm of knowledge and traditional hermeneutics contribute towards the end of the process without resolution of merit, returning the problem to society or to the arbitrary choice of principles and interpretative methods, which, in turn, cause divergent decisions for similar cases. Thus, the research presents a reflection on the right to land in the State of Pará from the historical and social aspect and an analysis of final court decisions on this right in light of hermeneutical theories, presenting a new proposal for hermeneutics, called legal hermeneutics Agroambiental and guided in the paradigm of the philosophy of language as an instrument in favor of the effectiveness and against arbitrariness in the application of the right to land.
