Previous issue date: 2017-03-10 / A quem cabe a última palavra sobre o que é constitucional ou não no ordenamento jurídico brasileiro? Tem o Supremo Tribunal Federal, por disposição constitucional, a função de ser o guardião da Constituição, porém não cabe a ele o poder de dizer por último, qual o direito aplicável ou não no Brasil, já que, ao realizar o controle jurisdicional de constitucionalidade, sua decisão muito embora dotada de efeito vinculante, não atinge, tal vinculação, a atividade típica do legislador. Desta forma, o Congresso Nacional está legitimado a discordar da decisão do Supremo Tribunal Federal, editando lei com o mesmo conteúdo já declarado inconstitucional pela Egrégia Corte. Acontece que, ao fazê-lo, o legislador estará aprovando lei federal e, portanto, um dos objetos passíveis de controle de constitucionalidade principal, exercido pelo Supremo Tribunal. Esse é, do ponto de vista técnico, um segundo controle possível, só que ao fazê-lo, o Supremo Tribunal Federal estará no seu âmago, controlando a própria discordância do legislador. A partir do estudo sobre os fins do Estado Constitucional e a legitimidade democrática do próprio controle jurisdicional de constitucionalidade, o presente estudo busca a partir da problemática levantada, sobre a existência não de o Supremo Tribunal em proceder o controle de constitucionalidade desse que seria, muito mais do que um simples exercício de sua competência constitucional. / Who is the last word about what is constitutional or not in the Brazilian legal system? The Federal Supreme Court, by constitutional provision, has the function of being the guardian of the Constitution, but it does not have the power to say, lastly, which law is applicable or not in Brazil, since in carrying out the judicial review of constitutionality, its Although binding, does not bind the typical activity of the legislator. In this way, the National Congress is entitled to disagree with the decision of the Federal Supreme Court, creating new law with the same content already declared unconstitutional by the Court. It turns out that in doing so, the legislator will be passing federal law and, therefore, one of the objects subject to control of main constitutionality, exercised by the Supreme Court. This is, from the technical point of view, a second possible control, but in doing so the Supreme Court will be in essence, controlling the legislator's own disagreement. Based on the study of the purposes of the Constitutional State and the democratic legitimacy of the constitutional jurisdiction itself, this thesis seeks to investigate the existence or not of the legitimacy of the Supreme Court to proceed with constitutionality control of the law that represents the legislator's disagreement with its decision.
