Previous issue date: 2014-02-26 / A presente pesquisa objetiva investigar o constitucionalismo contempor?neo ante a influ?ncia que recebeu do fen?meno da virada hermen?utico-lingu?stica, a qual prop?e um rompimento com o paradigma da metaf?sica, estendendo a an?lise da influ?ncia ao direito processual civil e aplicando brevemente algumas constata??es a essa prov?ncia do direito. Para tanto, inicialmente aborda a evolu??o hist?rica da modernidade ? p?s-modernidade, cotejando-a, em seguida, com a evolu??o hist?rica do constitucionalismo, bem assim considerando o ambiente democr?tico como condi??o necess?ria para a consolida??o do constitucionalismo contempor?neo. Trabalha, em seguida, a passagem da subjetividade metaf?sica, conexa ? modernidade, ? intersubjetividade p?s-metaf?sica, atualmente estimulada em certa medida pela p?s-modernidade e com o desenvolvimento da filosofia da linguagem, o que se pode considerar como fen?meno da virada hermen?utico-lingu?stica. Considera, na sequ?ncia, a ?ntima rela??o entre direito e linguagem e a not?ria influ?ncia que a teoria do direito sofreu ante ao fen?meno da virada hermen?utico-lingu?stica. Identifica, nesse mister, como se destacando duas heran?as a serem trabalhadas sob a perspectiva do direito, sendo a primeira a an?lise da legisla??o sob a perspectiva da semiologia do poder e a segunda, mais conexa ? lingu?stica, a an?lise da interpreta??o pelo aplicador do direito com o que considera as principais manifesta??es do fen?meno da incompletude do direito, quais sejam, os conceitos jur?dicos indeterminados e os princ?pios fundamentais de direito. Considera, na sequ?ncia, a evolu??o hist?rica do estudo do processo civil, levando em conta suas fases e atuais correntes de compreens?o, realizando apontamentos acerca da ?ntima rela??o entre processo e linguagem e acerca da aplicabilidade do fen?meno da virada hermen?utico-lingu?stica. Trabalha, enfim, as duas mencionadas heran?as da virada hermen?utico-lingu?stica que se encontram conexas ao direito processual: a an?lise da semiologia do poder ante ? legisla??o processual civil e a an?lise dos conceitos jur?dicos indeterminados e princ?pios fundamentais e como ocorre sua constru??o, agora obrigat?ria pela legisla??o processual civil, sobretudo atrav?s das heran?as paradigm?ticas j? evidenciadas. / The present research intents to investigate contemporary constitucionalism against the influence that it has suffered from de hermeneutic-linguistic turn, which proposes a disruption with the paradigm of metaphysics, extending the analysis of influence to the civil procedural law and applying quickly some findings to this juridical province. For that, initially approaches the historical evolution from modernity to postmodernity, collating it, in sequence, that with the historical evolution of constitucionalism, as well as considering democratic ambient as necessary condition for the consolidation of contemporary constitucionalism. Works, sequentially, the passage from the metaphysical subjectivity, connected with modernity, to the postmetaphysical intersubjectivity, currently stimulated in a certain way by postmodernity and with the development of linguistic philosophy, wich can be considered as the phenomenom of the linguistic turn. Considers, in sequence, the close relation between law and language and the notorious influence that law theory has suffered against the linguistic turn phenomenom. Identifies, in this purpose, as highlighting two heritages to be worked under perspective of law, being the first one the analisis of legislation under perspective of semiotics of power and the second one the analisis of interpretation by law applicator, with what it considers the principals manifestation of law incompleteness, wich are the indeterminate legal concepts and the fundamental constitucional principles. Considers, then, historical evolution of civil procedure law, taking in count its phase and current chains of comprehension, accomplishing notes about the close relation between procedure and language and about the applicability of linguistic turn phenomenon. Works, then, the two mentioned heritages of linguistic turn connected to civil procedure: the analisis of semiotics of power against procedural legislation and the analisis of indeterminate legal concepts and fundamental principles and how occurs is construction, now obligatory by the civil procedural legislation, about everything beyond the paradigmatic heritages already evidenced.
