Previous issue date: 2013 / A urbanização desordenada nos centros urbanos trouxe consigo inúmeros problemas para as cidades e munícipes, dentre eles as ocupações ilegais. Com o alto número deste tipo de habitações, faz-se necessário legalizar estas ocupações, de modo que haja uma coincidência entre possuidor da área e proprietário perante o Registro de Imóveis, pondo fim a uma série de problemas decorrentes desta ilegalidade. Pensando em tal problema e considerando que um dos requisitos necessários para efetivação da regularização é a prova do tempo de ocupação, a pesquisa propõe a utilização da aerofotogrametria, ciência que se utiliza de fotos aéreas, no auxílio a estas regularizações, fornecendo importantes informações sobre o tempo e espaço destas ocupações. A pesquisa tem por objeto área de estudo, uma propriedade no Município de Criciúma (SC), e chega a conclusão que a fotogrametria pode ser, de fato, auxílio na prova da ocupação de uma determinada área, bem como dos limites ocupacionais desta área, apoiando a efetivação da regularização fundiária e reconhecendo um dos direitos fundamentais constitucionalmente previstos: o direito à moradia digna e legalizada. Ao fazer isto, põe-se em prática a tão aspirada função social da propriedade, que é dever e direito de todos. <br> / Abstract : Rapid and disorderly urbanization in urban centers has brought many problems for cities and their residents, including the illegal occupations according to the law. Considering the high number of this type of housing , it is necessary to legalize these types of occupations, so that there is a coincidence between the owner and owner of the area before the Real Estate Registry, ending a series of problems arising from this irregularity. Putting this problem into account and considering that one of the requirements necessary for the execution of the regularization is proof of the occupation time, the research proposes the use of aerial photogrammetry, science that uses aerial photographs in aid to these adjustments, providing important information about the time and location of these illegal occupations. The survey has an area that is used for studying which is owned by the Municipal of Criciúma (SC), and comes to the conclusion that photogrammetry can be in fact, support of the occupation of a particular area at a particular time as well as the limits of this occupational area, supporting the effectiveness of legal and land tenure regularization and recognizing therefore one of the fundamental rights constitutionally provided, the right to housing, dignified and legalized. By doing so, puts into practice the much aspired social function of property, it is the duty and the right of all.
