A presente dissertação buscou conhecer as circunstâncias nas quais a adoção de
crianças e adolescentes atualmente ocorre no Brasil e, em especial, na Comarca de
Gurupi/TO, de modo a encontrar mecanismos que possam ser implantados pelo
Tribunal de Justiça do Tocantins que fomentem a adoção e incentivem a prática da
adoção tardia. Para isto, buscou-se conhecer a evolução histórica dos direitos da
criança e do adolescente e compreender, a partir da coleta de dados de pesquisas já
realizadas, os fatores que justificam os moldes em que se dá a atual cultura de
adoção. Utilizou-se de entrevistas e pesquisa bibliográfica. Verificou-se que é
imperiosa a implantação de práticas que possam provocar uma mudança na atual
cultura de adoção no Brasil. Para tanto, propõe-se ao Tribunal de Justiça do
Tocantins a adoção de mecanismos e de práticas que fomentem a adoção, em
especial, das crianças maiores de dois anos e de adolescentes, nos moldes do que
se identificou em outros estados da federação. / The present dissertation sought to know the circumstances in which the adoption of
children and adolescents currently occurs in Brazil, and especially in the Gurupi/TO
region, in order to find mechanisms that can be implemented by the Court of Justice
of Tocantins that foster the adoption and encourage the practice of late adoption. In
order to do so, it was sought to know the historical evolution of the rights of the child
and adolescent and to understand, from the collection of data of research already
done, the factors that justify the molds in which the current culture of adoption takes
place. They were used interviews and bibliographic research. It was verified that it is
imperative to implement practices that can provoke a change in the current culture of
adoption in Brazil. To this end, it is proposed that the Tocantins Court adopt
mechanisms and practices that foster the adoption, especially of children over two
years of age and of adolescents, in the way that has been identified in other states of
the federation.
