Previous issue date: 2008-03 / A tese mostra o modo como ocorreu uma gradual historicização do
pensamento hermenêutico, tanto na filosofia quanto no direito. Ela tem início
com uma reconstrução da hermenêutica filosófica, mostrando como as
reflexões hermenêuticas nesse campo deixaram de ser uma busca de identificar o método correto de interpretação e passaram a constituir uma reflexão acerca da historicidade do próprio ato de compreender e das implicações dessa consciência histórica nos nossos modos de compreensão. Em um segundo momento, ela traça os caminhos da hermenêutica jurídica na modernidade, mostrando como o discurso hermenêutico seguiu perspectivas opacas a sua própria historicidade (passando especialmente pelos positivismos normativistas do século XIX, pelas influências do positivismo sociológico e do neopositivismo lógico do início século XX e também pelas teorias da argumentação do final do século XX), mas que atualmente ganham força perspectivas teóricas que se apropriam das reflexões filosóficas e que, nessa medida, abriram espaço para a constituição de uma hermenêutica jurídica alinhada com o historicismo presente nas atuais concepções da filosofia hermenêutica. / This thesis evidences the gradual change towards historicization on the
hermeneutic though within Philosophy and Law. It starts with a
reconstruction of the philosophical hermeneutics, showing how hermeneutic
reflections in this field have ceased to search and to identify the correct method of interpretation and have changed into a reflection concerning the historicity of understanding and the implications of this historical consciousness in our ways of understanding. Next, this thesis traces the paths of legal hermeneutics in modernity, examining how the hermeneutic discourses have adopted perspectives that were blind to their own historicity (especially the normativist positivisms in XIXth century, the sociological positivism, the logical neopositivism in the beginning of XXth century and also the theories of argumentation in the late XXth century). It concludes by stating that nowadays 3 there is an increased relevance of juridical perspectives that, inspired in the philosophical reflections, have created the basis for the development of a juridical hermeneutics compatible with the historicism from current hermeneutical philosophy.
