Previous issue date: 2007-04-02 / Este estudo buscou identificar a solidez e a durabilidade dos pressupostos teóricos baseados na submissão do projeto educacional ao projeto de ajuste estrutural do capitalismo mundial, aceitos e defendidos pelo governo Fernando Henrique Cardoso. Nosso objetivo foi identificar na política de financiamento da educação básica proposta pelo primeiro Governo Lula, elementos de ruptura ou de continuidade com esses pressupostos. Em 2006 foi promulgada a Emenda Constitucional nº. 53 que criou o FUNDEB, estabelecendo um novo padrão de financiamento da educação básica. A EC nº. 53 não representou uma ruptura com a dinâmica de descentralização das políticas educacionais aplicada pelo governo anterior, mantendo inalteradas as competências entre os entes federados, inclusive utilizando uma interpretação bastante restritiva delas. Há ruptura com a focalização no ensino fundamental. A EC estabelece um fundo único para toda a educação básica. A proposta da União que excluía as matrículas de creche foi superada por pressão da sociedade civil. O papel constitucional da União não sofreu alteração. Manteve-se um papel suplementar e emergencial. Porém, foi uma ruptura parcial a elevação dos recursos de complementação da União, especialmente a inclusão de participação percentual de no mínimo 10% a partir do quarto ano de vigência do FUNDEB. __________________________________________________________________________________________ ABSTRACT / This study tried to identify the solidity and the durability of the theoretical presuppositions based on the submission of the education project to the structural adjustment project of the world capitalism, accepted and defended by the Fernando Henrique Cardoso’s Government. Our aim was to identify, in the financing policy of the basic education proposed by Lula’s Government, elements of rupture or of continuity with that presuppositions. In 2006, it was promulgated the Constitutional Amendment (AC) number 53, which creates the FUNDEB and that established a new financing pattern of the basic education. The Amendment number 53 didn’t represent a rupture with the dynamic of the decentralization of the education policy implemented by the prior government, keeping unaffected the competences among the federated entities, including utilizing an interpretation very restrictive of them; that is, inhibiting the occurrence of the “competence’s invasion”, which is, in many cases, the only possibility of the citizen to see guaranteed his/her right to the public and free education. There is a rupture with the focalization on the fundamental education. The AC establishes an only fund to all basic education. The proposal of the Union that excluded the enrollments at the crèches was defeated because of the pressure of the civil society. The Union constitutional role didn’t suffer changes. It kept to be a supplemental and emergency role. Nevertheless, it was a partial rupture the increase of the Union complementary resources, especially the inclusion of the percentage participation of at least 10% starting from the fourth year of the FUNDEB validity.
