Previous issue date: 2006-09-26 / Os Sistemas e Serviços de Telecomunicações móveis apresentaram uma evolução de dimensão inaudita durante a última década, tornando-se ponto de referência para o desenvolvimento de aplicações para os usuários e soluções tecnológicas para a transferência de informação na rede. Paralelamente a esta evolução, o desenvolvimento tecnológico conduz para a convergência dos diversos Serviços de Telecomunicações hoje existentes, em especial os suportados por Sistemas de Telecomunicações móveis e fixos, tornando comum a oferta de Facilidades aos usuários dos diversos Serviços, que somente possuem diferenciação regulatória. Desta forma, esta dissertação tem como objetivos: (i) discorrer sobre o histórico da prestação de Serviços de Telecomunicações no Brasil, seus agentes e a nova estrutura legal e regulamentar estabelecida posteriormente à Lei Geral de Telecomunicações - LGT, Lei No 9.472, de 16 de julho de 1997, marco legal das telecomunicações no Brasil; (ii) definir os termos Sistemas de Telecomunicações, Serviços de Telecomunicações e Facilidades, adentrando por seus contornos e sobreposições; (iii) analisar a evolução dos Sistemas de Telecomunicações móveis e fixos, considerando o progresso das redes de transporte e acesso, onde especificamente os Sistemas de Telecomunicações móveis possuem maior importância, por serem alavanca para o desenvolvimento das Redes de Próxima Geração (NGN: Next Generation Networks), baseadas em IP, que por sua vez envolverão todos os Sistemas de Telecomunicações; (iv) analisar as mudanças regulatórias necessárias para a sustentação desta evolução; e, (v) desenvolver uma proposta de para a prestação de Serviço de Telecomunicação convergente, isto é, que englobe os diversos Serviços existentes atualmente, abordando aspectos específicos do Brasil como a utilização da plataforma de rede de transporte e acesso existente, o suporte regulatório e uma nova fórmula de prestação de Serviços de Telecomunicações, abrangentes, eficientes, competitivos e auto-sustentáveis. ___________________________________________________________________________________________ ABSTRACT / Mobile Telecommunication Systems and Services have evolved in an unprecedented dimension during the last decade, becoming the reference point for user application development and technological solutions for the exchange of information in the network. In parallel with this evolution, the technological development leads to a convergence of all Telecommunication Services in existence today, specially those supported by the mobile and fixed Telecommunication Systems, turning the offering of Facilities to users of all types of services a common trend, which differentiate themselves only by the regulatory framework. Therefore, this paper has the following objectives: (i) to discourse about the history of Telecommunication Service offering in Brazil, the agents involved and the new legal and regulatory structure established after the “Lei Geral de Telecomunicações – LGT”, Law no 9.472, of july 16, 1997, telecommunication landmark in Brazil; (ii) to define the terms Telecommunication Systems, Telecommunication Services and Facilities, exploring their configuration and overlapping; (iii) to analyze the evolution of mobile and fixed Telecommunication Systems, considering the progress in transport and access networks, where mobile Telecommunication Systems have special importance, since they are the means for the development of the Next Generation Networks – NGN, IP based, which, in turn, involves all Telecommunication Systems; (iv) to analyze the changes in regulatory framework that are needed to support this evolution; (v) to develop a proposal for convergent Telecommunication Services, that encompass all the Services in existence today, analyzing specific aspects in Brazil, like the use of the transport and access network platform, the regulatory support and a new formula for Telecommunication Service offering, which are comprehensive, efficient, competitive and self-sustainable.
