Previous issue date: 2009-07 / Esta dissertação trata da dependência presidencial em relação às medidas provisórias à luz da racionalidade que envolve as escolhas legislativas do Executivo. Num enfoque pouco abordado pela literatura, este trabalho, ao examinar as decisões que resultam da interação estratégica entre Executivo e Congresso, reconhece, como variáveis que influenciam as escolhas do Executivo e do Congresso, não só os fatores que condicionam o conteúdo das políticas mas também os instrumentos legislativos utilizados para implementá-las. Avalia-se como os presidentes têm se comportado com relação à utilizaçao de medidas provisórias, sobretudo na perspectiva de que há outra escolha legislativa natural para alterar o status quo das políticas, qual seja os projetos de lei. Nesse contexto, a interação estratégica entre Executivo e Congresso é modelada como um jogo Bayesiano cujo resultado depende, fundamentalmente, das vantagens comparativas associadas a um e a outro instrumento legislativo e das crenças do Executivo com relação à receptividade do Congresso diante de sua iniciativa. Os resultados hipotéticos que decorrem do modelo sugerem que embora as medidas provisórias apresentem vantagens comparativas em relação ao projetos de lei, elas não necessariamente representam a melhor escolha do Executivo. O modelo sugere, ainda, que a dependência presidencial em relação às medidas provisórias tende a variar em função das regras do processo decisório e do comportamento do Congresso diante das escolhas executivas. ________________________________________________________________________________________ ABSTRACT / This dissertation is about the presidential dependence on decrees in the light of rationality involving the Executive's legislative choices. In an approach somewhat addressed by the literature, this work, in order to examine the decisions that result from the strategic interaction between the Executive and Congress, recognized as variables that influence the choices of the Executive and Congress, not only the factors that regulate the content of policies but also the legislative instrument used to implement them. I examine how the presidents have behaved with respect to the use of decrees (medidas provisórias), especially considering that there is another natural legislative choice to change the status quo of policies, which is the use of statutes (projetos de lei). In this context, the strategic interaction between the Executive and Congress is modeled as a Bayesian game. Its result depends crucially on the comparative advantages associated with one and other legislative instrument and on the Executive’s beliefs with respect to the receptivity of Congress in face of his initiative. The results arising from the model suggests that although the decrees have comparative advantages in relation to the statutes, they do not necessarily represent the Executive’s best choice. The model also suggests that presidential dependence on decrees tend to vary according to the rules of decision making and behavior of the Congress before the Executive’s choices.
