Previous issue date: 2006-03-13 / Nesta dissertação o autor pretende verificar a relação entre a mutação constitucional e a coisa julgada no controle abstrato de constitucionalidade realizado pelo Supremo Tribunal Federal. Para isso, o autor inicia a pesquisa com o estudo do desenvolvimento do conceito de mutação constitucional, desde sua formulação inicial por Jellinek, marcada pelo positivismo sociológico, até a que Hesse enuncia, já sob a influência da hermenêutica. Em seguida, o autor estuda a coisa julgada no controle abstrato de constitucionalidade, traçando as diferenças entre a coisa julgada em caso de controle concreto de constitucionalidade e a coisa julgada que recai sobre o julgamento de lei em tese.
