Previous issue date: 1991 / Resumo: Tratando da Educação Física na escola brasileira de 1o e 2o graus, buscamos analisar a influência exercida pela legislação no tocante a constituição da disciplina enquanto componente curricular. Assim, no transcorrer do trabalho objetivamos: 1 ¿ Selecionar e comentar alguns autores que mais recentemente têm tratado, em suas produções científicas, da questão histórica na Educação Física. Visando destacar o centro de atenção dispensado ao problema, ou seja, por onde esses autores conduziam sua análise; 2 ¿ Investigar, selecionar e apresentar a legislação específica referente a disciplina Educação Física, salientando sua importância na definição do projeto político destinado a matéria; 3 ¿ Analisar os documentos legais que, no período compreendido entre o final do século XIX até os anos 30 e 40 deste século, mais atenção chamou quanto aos debates e deliberações tomadas em relação ao problema da Educação Física; 4 ¿ Apontar a especificidade da Educação Física, em relação as outras disciplinas na escola de 1o e 2o graus, visivelmente exposta pela legislação. O trabalho baseou-se assim numa análise bibliográfica e documental. A análise documental requereu um ¿passeio¿ pela obra de autores que tratam da relação existente entre direito e lei, cuja distinção procuramos salientar. Além disso, buscamos demonstrar a diferença entre a forma funcionalista e dialética de encarar a lei... Observação: O resumo, na íntegra, poderá ser visualizado no texto completo da tese digital / Abstract: This paper deals with Physical Education in Brazilian Junior and sênior high-school and it attempts to analyse the influence of the laws concerning the subject as part of the school curriculum. Thus throughout the paper it is attempted: 1) to select and comment an some authors who have dealt more recembly, in their scientific research, with the history of Physical Education. The emphasis here is on the focus these authors have chosen to conduct their analysis; 2) to search into the specific law concerning the subject of Physical Education, select and present it emphasising its importance to the definition of a political project related t the subject; 3) to analyse the legal documents which called more attention to the debate and decisions taken concerning the problem of Physical Education from the end of XIX century to the 30¿ s and 40¿ s, this century; 4) to point out the specification of Physical Education in relation to other subjects in junior and senior high school as it becomes visible in the law. The research is based on bibliographical and documental analysis. The documental analysis required a browsing through the work of authors who deal with the relation between law and acts and a distinction between these is emphasized...
