Previous issue date: 2018-08-06 / Coordenação de Aperfeiçoamento de Pessoal de Nível Superior / The current dissertation has as its main goal the investigation regarding how gender influences the reality of rape in Brazil. Therefore, we used the deductive and the criticalanalytical methods, as well as primary and secondary sources and jurisprudence regarding the matter. Firstly we studied some concepts of the feminist theory, presented by authors Heleieth Saffioti, Susan Brownmiller and Catharine Mackinnon, who helped with the comprehension of gender constructions about women and its incidence in relation to rape. We then analyzed the international legislation's evolution that reverberated within the internal order, as well as studied the evolution of rape crime in the national legislation, always focusing on a gender perspective. Then, we set out to observe data on the Brazilian society, emphasizing the social impressions on rape and gender, as well as analyzing the number of notifications of rape in the country and the main characteristics of the people involved in the crime. We finalized the analysis with Precedent 608 issued by the Federal Supreme Court (STF), with the case of Inês Etienne, two matters of the legal world that help with the comprehension of how essential it is to discuss gender in order to avoid violations to women's rights. We verified that gender is directly related to rape, building hierarchy and naturalizing women's subjugation, its discussion being of primordial importance in the combat of sexual violence. / A presente dissertação tem como principal objetivo a investigação de como o gênero influencia na realidade do estupro no Brasil. Para tanto, utilizamos o método dedutivo e crítico analítico, além de fontes primárias, secundárias e jurisprudência relacionada à temática. Primeiramente estudamos alguns conceitos da teoria feminista, presentados pelas autoras Heleieth Saffioti, Susan Brownmiller e Catharine Mackinnon, as quais auxiliaram na compreensão das construções de gênero sobre a mulher e sua incidência com relação ao estupro. Partimos para a análise da evolução legislativa internacional que surtiram efeito no ordenamento interno, além de estudar a evolução do crime de estupro na legislação nacional, sempre com uma perspectiva de gênero em foco. Seguimos então, para a observação de dados sobre a sociedade brasileira, ressaltando as impressões sociais sobre o estupro e o gênero, além de analisarmos os números de notificações de estupro no país e as principais características dos sujeitos envolvidos no delito. Finalizamos a análise com a Súmula 608 do Supremo Tribunal Federal, com o caso de Inês Etienne, duas questões do mundo jurídico que auxiliam na compreensão de como é essencial discutirmos gênero para evitar violações aos direitos das mulheres. Constatamos que o gênero está diretamente relacionado ao estupro, criando hierarquias e naturalizando a subjugação das mulheres, sendo primordial sua discussão no combate a violência sexual.
