Previous issue date: 2012-01-05 / The current work aims to analyze the judicial function and civil procedure in two different stages: the formation of the 1973 Civil Procedure Code in its original structure and the period after the Federal Constitution. Therefore, firstly some of the institutes of civil procedure and main characteristics that influenced the practice of law during that period are analyzed, in an effort to demonstrate the structural influences over the judicial function exercised by the Judiciary. Secondly, the post- 1988 Federal Constitution period and its important consequences over the structure and functioning of civil courts are approached. Finally, this study examines the current characteristics of civil procedure and the judicial function, by looking into the institutes of binding precedents, general repercussion, repetitive appeals, the socalled objective processes and class actions. As a conclusion, it is possible to affirm that the Judiciary has to perform a new role: the creation of general and abstract rules. The prevalence of a collective perspective in dispute resolution demonstrates the overcoming of the idea that the main role of the Judiciary would solely be to apply general law to particular cases, which involved primarily individual interests / O presente trabalho visa a analisar a fun??o judici?ria e o processo civil sob dois momentos distintos: a forma??o do C?digo de Processo Civil de 1973 em sua estrutura origin?ria e o per?odo p?s Constitui??o Federal. Para tanto, na primeira etapa s?o abordados alguns dos institutos do processo civil e algumas das principais caracter?sticas que exerceram influ?ncia na utiliza??o e no modo de aplicar o direito durante esse per?odo. S?o demonstradas com destaque as influ?ncias estruturais e seus reflexos na fun??o jurisdicional exercida pelo Poder Judici?rio. No segundo cap?tulo, o trabalho enfrenta o per?odo p?s-Constitui??o Federal de 1988 e as principais transforma??es da? decorrentes, que alteraram sensivelmente a estrutura do processo civil e a fun??o jurisdicional. Na an?lise do processo civil e das caracter?sticas atuais da Jurisdi??o, o trabalho enfrenta o tema das s?mulas vinculantes, da repercuss?o geral, do julgamento dos recursos repetitivos, dos denominados processos objetivos e das a??es coletivas, para, ao final, concluir que o Judici?rio passou a exercer uma nova fun??o, qual seja, a cria??o de normas gerais e abstratas. A preval?ncia do interesse de garantir a resolu??o de controv?rsias em uma perspectiva coletiva e transindividual demonstra a supera??o da ideia de que ao Judici?rio caberia t?o somente a tarefa de aplicar a norma geral ao caso concreto em a??es com interesses puramente individuais
