Previous issue date: 2012-03-29 / This dissertation attempts to evaluate the existence and importance ofnot juridical motivations in two major trials concerning the applicability of the Complementary Law no. 135/2010, also known as the Lei da Ficha Limpa. Search check, in the votes of the judgesof the Supremo Tribunal Federaland the Tribunal Superior Eleitoral, if there was to carry out calculations of risk of a political nature. Still, there is the intention of identifying the main thematic lines of not juridical manifestation, and check if they, by themselves, are able to place the judges in favor oragainst the applicability of the Lei da Ficha Limpain 2010. From the theoretical perspective, findthe origins of the judiciary, its relationship with the executive and legislature, and are discussed theories on constitutionalism and the constitutional judicial rewiew. The judicialization of politics,in its typefrom without, occupies a central position, and is directly related to the performance of the judiciary in adjudicating cases involving electoral competition. The work also weaves the path of the Lei da Ficha Limpasince its popular initiative, reporting passage through the legislative and executive branches and the arrival of the judiciary. Upon transcription of excerpts from each of the votes took place on the Supremo Tribunal Federal and the Tribunal Superior Eleitoralsets the standard decision of both courts, highlighting the main topics of notlegal discussion. Demonstrates that the judicialization of politics in Brazil,judgments about the rules of electoral competition, an environment that allows you to large expansion. / Esta disserta??o intenta avaliar a exist?ncia e a import?ncia de motiva??es extrajur?dicas em dois dos principais julgamentos relativos ? aplicabilidade da Lei Complementar n? 135/2010, tamb?m conhecida como Lei da Ficha Limpa. Busca verificar, nos votos dos ministros do Supremo Tribunal Federal e do Tribunal Superior Eleitoral, se houve a realiza??o de c?lculos de risco de natureza pol?tica. Ainda, h? a pretens?o de identificar as principais linhas tem?ticas de manifesta??o extrajur?dica, e verificar se elas, por si, s?o capazes de posicionar os magistrados a favor ou contra a aplicabilidade da Lei da Ficha Limpa no ano de 2010. Sob o prisma te?rico, h? um resgate das origens do Poder Judici?rio, sua rela??o com o Executivo e o Legislativo, bem como s?o abordadas teorias sobre o constitucionalismo e sobre o controle de constitucionalidade. A judicializa??o da pol?tica, em sua dimens?o from without, ocupa posi??o central, e ? relacionada diretamente com a atua??o do Poder Judici?rio no julgamento de casos envolvendo competi??o eleitoral. O trabalho ainda tece o caminho da Lei da Ficha Limpa desde a sua iniciativa popular, relatando a passagem pelos poderes Legislativo e Executivo e a chegada ao Judici?rio. Mediante transcri??o de trechos de cada um dos votos ocorridos no Supremo Tribunal Federal e no Tribunal Superior Eleitoral, estabelece o padr?o decis?rio dos dois tribunais, salientando os principais temas extrajur?dicos de debate. Demonstra que a judicializa??o da pol?tica no Brasil encontra, nos julgamentos sobre regras de competi??o eleitoral, um ambiente que lhe permite franca expans?o.
