Previous issue date: 2015-08-31 / This study describes collective bargaining and case law as sources of Labor Law, analyzing their characteristics, limitations and effects concerning individual employment contracts. Finally, the intention of this study was of analyzing all of these matters under the terms of the new text of Precedent 277 of the Superior Labor Court pursuant the concept of applicability after abrogation. The study first examined collective self-regulation, its concept, background, characteristics and, specifically, its two instruments of concretion, which are collective-bargaining agreements and collective labor agreements. The second part of the study explored case law as a source of Labor Law, it being contemplated in manner of collective labor disputes and the normative power of Labor Courts that presents itself by means of judicial disposition of collective labor grievances. As to reach the final purpose of this study, it was necessary to analyze the limits of such normative power. Finally, the concept of collective private autonomy was ascertained, as well as the problems deriving from the incorporation of collective rules to individual employment contracts. In these terms, this study undertakes, as its main purpose, to analyze the collective private autonomy and case law as sources of Labor Law rules, given their peculiarities, especially in light of the new text of Precedent 227 of the Superior Labor Court. This study elected bibliographical research as its main instrument of investigation. / O presente estudo descreve a negocia??o coletiva e a jurisdi??o como fontes do Direito do Trabalho, analisando as suas caracter?sticas, limita??es e efeitos em rela??o aos contratos individuais de trabalho. Por fim, a pretens?o era a de analisar todas essas quest?es a luz da nova reda??o da S?mula 277 do TST frente ao conceito de ultratividade. Analisou-se em um primeiro momento a autorregulamenta??o coletiva, seu conceito, hist?rico, caracter?sticas e mais precisamente, os seus dois instrumentos de concre??o, quais sejam, a conven??o e o acordo coletivo de trabalho. Na segunda parte deste trabalho, foi estudada a jurisdi??o como fonte do Direito do Trabalho, sendo a mesma tratada na figura do diss?dio coletivo e do poder normativo da Justi?a do Trabalho que se apresenta pela senten?a normativa. Para o alcance do objetivo final do presente estudo, necess?ria a verifica??o dos limites do poder normativo. Por fim, foi estudado o conceito da autonomia privada coletiva e a problem?tica de incorpora??o das normas coletivas aos contratos individuais de trabalho. Nesses termos, o presente estudo assume como objetivo principal a an?lise da autonomia privada coletiva e a jurisdi??o como fonte de regras de Direito do Trabalho, a partir das suas particularidades, especialmente ? luz da nova reda??o da S?mula 277 do TST. Adotou-se a pesquisa bibliogr?fica como principal instrumento desta investiga??o.
