Previous issue date: 2016-12-09 / This work is an interdisciplinary investigation of natural argumentation focusing on arguments of legal/political interest. Around the natural argumentation, there is a historical debate that polarizes the subject between a theoretical-formal issue and informal-practical issue. This split was already present in ancient Greece, with Plato and Aristotle on the one hand, and the Sophists on the other; and the topic is still controversial. Grice (1957), philosopher and logician, was one of the first to recognize that there should be compatibility between the formal and the informal as types of argumentation. For him, whether in more technical contexts or in more ordinary contexts, human rationality is the same. His proposal is a landmark for the so-called inferential pragmatics. On the other hand, Toulmin (1958) defended the idea that it is a matter of distinguishing the systematic study of the semantic proposition (idealized logic) of the pragmatic approach as uses of arguments. In the philosophy of logic, there is a general tendency to a perspective of preservation of formal aspects, as, for example, Frege and Russell did; however, there are those, such as Walton, Perelman, among others, inspired by Strawson, Grice and Austin,
who try to develop a pragmatic approach to logic that complements formal and informal logic. Our thesis is that rationality must be assumed in a broad sense and that it underlies natural arguments, whether more formal, as the scientific ones, or more informal, as the everyday ones. We use inferential pragmatics because it makes connections with truth-conditions semantics (close to formal logic) and with two forms of argumentation, the legal-political argumentation and the ordinary one. Jurists, such as Hans Kelsen, Recas?ns Siches, Robert Alexy and Cha?m Perelman, among others, try to identify the scientific value of the area of Law by seeking the foundations of logic and the legal bases of rationality in its hermeneutical properties. Like some of these, they seek to establish the nature of legal argumentation. We assume, given the notion of scientific perspectivism (Giere), that every theoretical approach is a perspective and that an interdisciplinary perspective can be developed from the metatheory of interfaces through internal and external interfaces.
Considering this, our theoretical-argumentative study aimed to bring contributions to the interfaces between formal and informal arguments in its dimensions of legal-political use or daily use, by means of the bases of inferential pragmatics, such as the Gricean implicatures. / Este trabalho ? uma investiga??o interdisciplinar da argumenta??o natural, cujo t?pico envolve argumentos de interesse jur?dico-pol?tico. Em torno da argumenta??o natural, h? um debate hist?rico que polariza o tema entre te?ricoformal e informal e pr?tico. Essa cis?o j? estava presente na Gr?cia antiga, com Plat?o e Arist?teles, de um lado, e sofistas de outro; e ainda ? debatida. Grice (1967), fil?sofo e l?gico, foi um dos primeiros a reconhecer que deveria haver compatibilidade entre o formal e o informal, enquanto tipos de argumenta??o. Para ele, seja em contextos mais t?cnicos, seja em contextos mais ordin?rios, a racionalidade humana ? a mesma. Sua proposta ? um marco para a chamada pragm?tica inferencial. Toulmin (1958) defendeu, diante disso, a ideia de que se trata de distinguir o estudo sistem?tico da proposi??o sem?ntica (l?gica idealizada) da abordagem pragm?tica enquanto usos dos argumentos. Na filosofia da l?gica, h? uma tend?ncia geral a uma perspectiva de preserva??o de aspectos formais, como,
por exemplo, o fizeram Frege e Russell; contudo, h? aqueles, como Walton, Perelman, entre outros, inspirados em Strawson, Grice e Austin, que tentam desenvolver uma abordagem pragm?tica de l?gica que fa?a complementares l?gica formal e informal. Nossa tese ? a de que a racionalidade deve ser assumida em
sentido amplo e que esta subjaz aos argumentos naturais, seja dos mais formais, como os cient?ficos, seja dos mais informais, como os cotidianos. Utilizamos a pragm?tica inferencial por esta fazer conex?es com uma sem?ntica dos condi??es-de-verdade (pr?xima ? l?gica formal) e paralelamente duas formas de argumenta??o, a de interesse jur?dico-pol?tico e a cotidiana. Juristas, como Hans Kelsen, Recas?ns Siches, Robert Alexy e Cha?m Perelman, entre outros, tentam identificar o valor cient?fico da ?rea do Direito, buscando os fundamentos da l?gica e as bases jur?dicas da racionalidade em suas propriedades hermen?uticas. Assim como alguns destes procuram estabelecer a natureza da argumenta??o jur?dica.
Assumimos que toda abordagem te?rica ? uma perspectiva, conforme a no??o de perspectivismo cient?fico (Giere) e que uma perspectiva interdisciplinar pode ser desenvolvida a partir da metateoria de interfaces por meio de interfaces internas e externas. Considerando-se isso, o nosso estudo de car?ter te?rico-argumentativo teve por objetivo, com as bases da pragm?tica inferencial, como as implicaturas griceanas, trazer contribui??es ?s interfaces entre o argumento formal e o informal em suas dimens?es de uso jur?dico-pol?tico ou cotidiano-usual.
