O presente trabalho tem como objetivo investigar e elucidar a dinâmica da construção institucional da Advocacia-Geral da União (AGU) no espaço político da Assembleia Nacional Constituinte (ANC) de 1987-1988, mapeando quais atores foram mobilizados na arena política decisória no período de redemocratização política brasileira. O contexto histórico que precedeu o surgimento da AGU – com seu atual desenho institucional - rememora o fato de que suas atribuições contemporâneas de representação judicial e de consultoria e assessoramento jurídicos da União, autarquias e fundações públicas federais eram exercidas, respectivamente, pelo Ministério Público da União e pela Consultoria- Geral da República. A hipótese construída gira em torno da perspectiva de que a AGU entrou no campo jurídico seguindo a mesma lógica dos demais atores – Judiciário e Ministério Público -, ou seja, ativando mobilização política de integrantes das carreiras e de “seus” representantes legislativos. Analisaremos a correlação dos campos jurídico e político em torno dos grupos dirigentes da AGU, e até mesmo da cúpula diretiva existente antes de sua instituição, trabalhando com a circulação destes agentes em diversos espaços de poder estatal, de modo particular em cargos do poder executivo e posições na elite judiciária. Proporemos uma análise da estrutura do campo jurídico existente no ambiente histórico da Constituinte, identificado por seus agentes e suas ações, conforme a representatividade de seus respectivos capitais simbólicos, bem como as posições de poder, novas ou reproduzidas, caracterizado pela luta por uma parcela de poder do Estado, em especial o exercício de uma competência específica monopolizada. Por fim, traremos elementos contemporâneos da atuação da AGU na representação judicial dos Poderes da República, no intuito de conferir maior poder explicativo às alterações verificadas no campo jurídico depois da ANC. / This paper aims to investigate and elucidate the dynamics of the institutional construction of the Federal Attorney General's Office (AGU) in the political space of the national constitutional convention (ANC) of 1987-1988, mapping which actors were mobilized in the political decision-making arena of the redemocratization that took plane in contemporary Brazil. The historical context that preceded the emergence of the AGU with its current institutional design, it is recalled that its contemporary attributions of judicial representation and legal advice and counseling of the federal institutions were exercised, respectively, by the Federal Public Prosecutor's Office and by the Republic General Consultant. The hypothesis presented revolves around the perspective that the AGU was created by the new Constitution of Brazil following the same logic of the other actors in the legal system – e.g. judges and prosecutors -, that is, through active political mobilization of career members and "their" legislative representatives. It will be analyzed the correlation of Law and Politics in the managing groups of the AGU, and even of the directive leadership existing before its creation, demonstrating the movement of these political/law agents in different spaces of power, particularly in the Executive and Judiciary branches. The judicial field´s structure before and after the ANC will be scrutinized, with the identification of key actors and actions, according to their political weight representativeness. Finally, contemporary elements of the AGU's performance before the Judiciary Branch will be discussed, in order to demonstrate the profound modifications operated by the ANC in the brazilian legal system.
