This essay analyzes the legal discourse that is materialized in the text of the law and in the official documents of the State on the imprisoned woman and the payment of her sentence. Therefore, we seek theoretical framework on Discourse Analysis (DA) of the French line and pecheutian aspect, allowing a discursive analysis of materialist basis, which considers the real history and language as socio-historical object. We seek foundation in the work developed by Orlandi, beyond Marx’s, Lukacs’ and Mészáros’ texts. From this theoretical perspective, it seems that in the historical processuality in which is said of the imprisoned woman, there are contradictions that reflect the gap between the law and the daily life of prisons, besides the class and gender inequalities that constitute the capitalist society. From the objectivity of solid social relations and productions related to the object, the corpus of this research consisted of extracted materialities from the following official documents: Criminal Enforcement Law (1984), Regulation of the Penitentiary System of the State of Alagoas (2000) and the Primer Imprisoned Women (2011). Thus, considering the relationship between ideology, history and subject, this essay reveals the meaning effects of legal discourse (re)produced in those official documents intended not only for the application of a penalty and the establishment of an order, but for the penalty’s place and form that the woman in seclusion situation is submitted. / Fundação de Amparo a Pesquisa do Estado de Alagoas / Coordenação de Aperfeiçoamento de Pessoal de Nível Superior / Esta dissertação analisa o discurso jurídico que se materializa no texto da lei e nos documentos oficiais do Estado sobre a mulher presa e o cumprimento de sua pena. Para tanto, buscamos referencial teórico na Análise do Discurso (AD) de linha francesa e vertente pecheutiana, o que possibilitou uma análise discursiva de base materialista, que considera o real da história e a língua como objeto sócio-histórico. Buscamos, também, fundamento nos trabalhos desenvolvidos por Orlandi, além dos textos de Marx, Lukács e Mészáros. A partir dessa base teórica, percebe-se que, na processualidade histórica em que circulam os dizeres sobre a mulher presa, há contradições que refletem na descontinuidade entre a lei e o cotidiano dos presídios, além das desigualdades de classe e de gênero que constituem a sociedade capitalista. Partindo da objetividade das relações sociais concretas e das produções relacionadas ao objeto, o corpus desta pesquisa foi constituído de materialidades extraídas dos seguintes documentos oficiais: Lei de Execução Penal (1984), Regulamento do Sistema Penitenciário do Estado de Alagoas (2000) e a Cartilha da Mulher Presa (2011). Assim, considerando a articulação entre ideologia, história e sujeito, esta dissertação desvela os efeitos de sentido do discurso jurídico (re)produzido nesses documentos oficiais destinados não apenas à aplicação de uma pena e ao estabelecimento de uma ordem, mas à configuração do lugar e da forma da pena a que a mulher em situação de reclusão está submetida.
