This essay studies the role of the Judiciary branch in the implementation process of the
economic, social and cultural rights (ESC Rights), like the right to health care, education, housing
etc. The goal of the study consists of an analysis of what the judges can do to enforce the
implementation of the ESC Rights without interfering with the functions and responsibilities of
the other branches (Executive and Legislative), that are, in a democracy, the main branches
responsible for implementing social policies. Based on a favorable opinion about the fundamental
rights and the judicial review, it defends an active role of the judges in the search for maximum
efficiency of the social rights entrenched in the Constitution and in the international treaties. The
study of the doctrine and the jurisprudence, in Brazil and in other countries, indicates that there
is a tendency for a larger acceptance of the justiciability of the ESC Rights, especially in the
developing countries. In these countries, the democratic institutions, like the parliament and the
government elected by the people, are incapable of reducing the social injustices. Therefore, the
Judiciary becomes a concrete hope of implementation of the socio-economics goals established
in the Constitution. In this context, arises the possibility of enforcement of the ESC Rights by
the judges. However, to accept the possibility of the judicial enforcement of these rights demands
the development of creative solutions to overcome the obstacles that appear in the compliance of
the judicial order. The essay proposes some strategies to implement the ESC Rights in the judicial
arena, based on the experience of many courts around the world / Esta dissertaÃÃo analisa o papel do Poder JudiciÃrio no processo de implementaÃÃo dos direitos econÃmicos, sociais e culturais, como o direito à saÃde, à educaÃÃo, à moradia, à alimentaÃÃo etc. O objetivo do estudo consiste em verificar atà que ponto os juÃzes podem agir para efetivar os direitos econÃmicos, sociais e culturais sem invadirem o campo de atuaÃÃo prÃprio do Legislativo
e do Executivo, que sÃo, em uma democracia, os principais responsÃveis pela definiÃÃo e execuÃÃo das polÃticas sociais. Tendo como pressuposto uma visÃo favorÃvel dos direitos
fundamentais e do Poder JudiciÃrio, defendo uma postura atuante por parte dos juÃzes na busca da mÃxima efetividade dos direitos socioeconÃmicos previstos na ConstituiÃÃo Federal e em
diversos tratados internacionais. A anÃlise da doutrina e da jurisprudÃncia, no Brasil e no mundo, aponta para uma aceitaÃÃo cada vez maior da plena e imediata justiciabilidade dos direitos
econÃmicos, sociais e culturais, especialmente nos paÃses em desenvolvimento. Nesses paÃses, em que os mecanismos democrÃticos por excelÃncia (governo e parlamento eleitos pelo povo) sÃo incapazes de possibilitar a reduÃÃo das desigualdades sociais, o JudiciÃrio surge como uma concreta esperanÃa de realizaÃÃo dos objetivos socioeconÃmicos estabelecidos na ConstituiÃÃo. Ã nesse contexto que surge a possibilidade de implementaÃÃo dos direitos econÃmicos, sociais e culturais pelo Poder JudiciÃrio. Por outro lado, a adoÃÃo da tese da efetivaÃÃo judicial dos direitos econÃmicos, sociais e culturais exige que sejam desenvolvidas soluÃÃes criativas no intuito de superar as barreiras que podem surgir no decorrer do processo de cumprimento da ordem judicial. Nesta dissertaÃÃo, sÃo apresentadas algumas estratÃgias visando a facilitar a realizaÃÃo dos direitos socioeconÃmicos na via judicial, baseadas na experiÃncia de inÃmeras Cortes pelo mundo afora
