Previous issue date: 2006 / The present work intend to analyze the use of financial market, especially the exchange market and the alternative systems of funds remittances, to transform and to give the appearance of legality to the resources taken with illicit practice, that is to say, for money laundering. In reason of the complexity of these subject, to understand these processes, it was necessary to exceed the legal analysis, entering in the historical-sociological and economic aspects involved in the construction of the Contemporary State, in the formation of financial and economic world markets, as well as in the influence that the growth of the complexity of the relations, the technological advance and factors like the globalization had exerted on these systems. The inquiry includes the operation of the Brazilian exchange market, as formal as parallel, and how are done the operations of international remittances in this universe, wich are insert the Alternative Systems of Funds Remittances, as they are called. Within ‘crime and punishment in complex societies’ research line, the examination covered, also, on what the called “money laundering” is builded up, with its criminal legal aspects and how the system is managed for its prevention and repression, verifying which is the relation and how the processes of international funds remittances are used as a tool for this purpose. Through the research realized, was possible to evidence the creation of a ‘virtual network’ by the national States, wich constitutes the prevention and repression system of money laundering that, even though represents significant improvement of the prevention and repression techniques of crimes from this nature, as well as the system looks for using speed against speed, technological evolution against technological evolution, and virtuality against virtuality, it still requires for improvement with the adoption of other measures equal to present confrontation ways to fragmentary systems which operate in the complexity, which is the case of the alternative systems of funds remittances. / O presente trabalho objetiva analisar a utilização do mercado financeiro, especialmente do mercado de câmbio e dos sistemas alternativos de remessas de fundos, para transformar e dar aparência de legalidade aos recursos obtidos com a prática de ilícitos, ou seja, para a lavagem do dinheiro. Em razão da complexidade da matéria, para a compreensão destes processos se fez necessário transcender a análise jurídica, ingressando nos aspectos histórico-sociológicos e econômicos envolvidos na construção do Estado Contemporâneo, na formação dos mercados financeiros e econômicos mundiais, bem como na influência que o crescimento da complexidade das relações, o avanço tecnológico e fatores como a globalização exerceram sobre estes sistemas. A investigação inclui o funcionamento do mercado cambial brasileiro, tanto formal quanto paralelo, e como se processam as operações de remessas internacionais neste universo, onde se inserem os chamados Sistemas Alternativos de Remessas de Fundos. Dentro da linha de pesquisa crime e punição nas sociedades complexas, o exame abrangeu, ainda, no que se constitui a denominada “lavagem de dinheiro” com seus aspectos jurídico-penais e como está posto o sistema para sua prevenção e repressão, verificando-se qual a relação e de que forma os processos de remessas internacionais de fundos são utilizados como ferramenta para este fim. Frente ao levantamento realizado, foi possível constatar a criação por parte dos Estados nacionais de uma “rede” virtual a qual constitui o sistema de prevenção e repressão à lavagem de dinheiro que, embora represente significativo aprimoramento das técnicas de prevenção e repressão a crimes dessa natureza, na medida em que o sistema procura empregar velocidade contra velocidade, evolução tecnológica contra evolução tecnológica e virtualidade contra virtualidade, ainda carece de aprimoramento, com a adoção de outras medidas capazes de apresentar caminhos de enfrentamento a sistemas fragmentários que operam na complexidade, caso dos sistemas alternativos de remessas de fundos.
