Previous issue date: 2006 / This work identifies with the research line criminal politics, State and limitation of the punitive power, because it aims at restricting the incidence of the criminal law, legalizing the abortion during the first three months of gestation. Assuming that the right to the life does not possess an absolute character and its not the highest value among the other human rights, and considering that the principle of human dignity should be the path of interpretation of these rights, the abortion should be legalized as long as based on a system that combines deadline and recomendations. In that way, the conduct wouldn´t be punished during the first twelve weeks of pregnancy. After this, the legality of the abortion would be conditional to the presence of specific recommendation. / Este trabalho identifica-se com a linha de pesquisa política criminal, Estado e limitação do poder punitivo, uma vez que objetiva restringir a incidência do direito penal, descriminalizando o aborto durante os três primeiros meses de gestação. Partindo do pressuposto que o direito à vida não possui caráter absoluto e axiológico superior aos demais direitos fundamentais, e considerando ser o princípio da dignidade humana o vetor de interpretação na otimização destes direitos, legitima-se a realização do aborto, desde que fundamentado num sistema que combine prazo e indicações. Desse modo, a conduta não seria punível durante as doze primeiras semanas de gestação, sendo que, após esse período, a licitude do aborto estaria condicionada a presença das causas específicas de justificação, ou melhor, indicações.
