Previous issue date: 2007 / The present dissertation aims to demonstrate that the current Brazilian Constitution overcame the Tripartite Theory of State Government as far as institutions are concerned. We hold the existence of institutions like the Public Prosecution Office and the Audit Office which are not part of the Legislative, the Executive or the Judicial branches. We begin by expounding the State Power’s historical and theoretical process of organization. We inquire into the classical tripartition from its earliest origins in Ancient Greece to its historical repercussions in United States Independence and in French Revolution. Then we present the criticism to the aforementioned Montesquieu’s theory, as well as its supporting arguments. At a later stage of the process of power ordering we advance the analysis of the following contemporary theoretical contributions: the theory of state functions and the autonomist conceptions of the Constitutional Court, the Government and the Public Administration. Regarding the 1988 Federal Constitution, an understanding of the political power guided by the lexical interpretive method and consonant with the traditional Tripartite Theory is shown. Thereafter, based upon the systematical interpretation and the principle of constitutional unity, and faced with autonomous state institutions, such understanding is subsequently rejected as we affirm the overcoming of the classical tripartition in the current Constitutional Charter. Instead of three separated powers we sustain the existence of five constitutional functions that operate cooperatively in Brazilian sovereignty’s constitutional order: executive, legislative, judicial, of public prosecution and of external control. / Esta dissertação possui a finalidade de demonstrar que, sob a ótica institucional, a atual Constituição brasileira ultrapassou a tradicional teoria tripartite do poder do Estado. Sustenta-se a existência de instituições, como o Ministério Público e os Tribunais de Contas, que não estão inseridas no Legislativo, Executivo ou Judiciário. No início do trabalho, é exposto o processo histórico-doutrinário da organização da potestade estatal. Investiga-se a clássica tripartição, desde as origens mais remotas, na Grécia Antiga, até as suas repercussões históricas, na independência dos Estados Unidos e na Revolução Francesa. Em seqüência, são apresentadas as críticas feitas à mencionada teoria de Montesquieu, bem como os respectivos argumentos de defesa. Numa etapa mais avançada do processo de ordenação da potestade, são analisadas as seguintes contribuições doutrinárias contemporâneas: a teoria das funções estatais, bem como as idéias autonomistas do Tribunal Constitucional, do governo e da administração pública. Quanto à Constituição Federal de 1988, a priori, é exteriorizado um entendimento da organização do poder político, norteado pelo método interpretativo léxico, e em sintonia com a tradicional teoria tripartite. Após, com fundamento na interpretação sistemática, no princípio da unidade constitucional e na presença de instituições estatais autônomas, é rejeitada a referida concepção literal, sustentando-se a superação da tripartição clássica, na atual Carta Magna. Ao revés de três poderes separados, é afirmada a existência, na ordenação constitucional da soberania brasileira, de cinco funções estatais atuantes em regime de cooperação: executiva, legislativa, judiciária, ministerial pública e de controle externo.
