Previous issue date: 2008 / Corporate personhood or natural personhood is atribute of natural or collective person, being addreseee of rights an of obligations; being undisouted still, that the juristic person´s is distinct frim that of its members, and that each member has its patrimonial autonomy, whose patrimonial separation can be relative when supreme values are pute at risk ih the natural or the juristic person is used for illegitimate purposes and to act fraud of the rights in order one´s rights. In this case, under the risk of total inversion os scale and interests, natural or juristic personhood can and must legally be disregard in legitimate reaction to the illicit handing of its patrimonial autonomy with the malicious interposition of natural or juristic person, having the judge the task of hindering the fraud for the bad use personhood that episodically will be disregarded, especially in the scope of Family Law and Law of Succession. / A personalidade física ou jurídica é atributo da pessoa natural ou coletiva, entre destinatário de direitos e de obrigações, sendo incontroverso ainda, que a pessoa jurídica tem existência distinta de seus membros cada qual tem sua autonomia patrimonial, cuja separação patrimonial pode ser relativizada, quando valores supremos são colocados em risco se a pessoa física ou jurídica for usada para propósitos ilegítimos e atuar em fraude ou abuso do direito para lesar direito alheio. Nesse caso e sob pena de total inversão da escala de valores e interesses, a personalidade física ou jurídica pode e deve ser judicialmente desconsiderada, em legítima reação ao ilícito manejo da sua autonomia patrimonial com a maliciosa interposição da pessoa física ou jurídica, cuidando o julgador de impedir a fraude pelo mau uso da personalidade que será episodicamente desconsiderada, em especial no âmbito do Direito de Família e das Sucessões.
